RESOLUTION 2003-23 <br />APPROVING FINDINGS OF FACT FOR AMENDING THE PARK <br />DEDICATION REQUIREMENTS BY INCREASING THE AMOUNT OF LAND <br />DEDICATION FROM SEVEN PERCENT TO 10 PERCENT AND PROVIDING <br />CRITERIA FOR THE COLLECTION OF PARK FEES <br />WHEREAS, the City of Hugo desires to develop a system of parks within the community <br />to serve the public's health and recreational needs, and; <br />WHEREAS, the City Council has adopted a comprehensive Park Master Plan in March <br />1998 that identifies reasonable needs for parkland and recreational facilities based on the <br />demand placed on the park system by the projected population associated with new <br />development in the community, and; <br />WHEREAS, the proposed ordinance amendments are needed to fully implement the Park <br />Master Plan as adopted, and; <br />NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF <br />THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the <br />amendment to the park dedication ordinance, based on the findings contained in the staff <br />report dated April 3, 2003, and including the following findings: <br />1. The 10 percent land dedication requirement is needed to establish an adequate <br />park and trail system at the level of service identified in the Parks Plan. <br />2. The proportionate share of land to be dedicated for parks or the fees in lieu of <br />dedication is based on the expected number of residents in a new development. <br />Based on the Parks Plan, the City is attempting to acquire 0.012 acres of parkland <br />per person. Specifically, the park plan identifies approximately 185 acres of <br />parkland for a projected population of 15,100 by 2020. <br />3. Residential development creates approximately 90% of the need for park and <br />recreational land and facilities in Hugo, and commercial industrial development <br />creates approximately 10% of the need. The amount of land dedication or fees <br />required by the ordinance is proportional to the need created by the development. <br />4. The fee in lieu of land dedication is based on the value of the land in the <br />community.
