FOR "ONEKA PONDS" ON PROPERTY LOCATED NORTH OF 122b STREET AND WEST OF EVERTON AVENUE WHEREAS, Fegowi Development, Inc. has requested approval of a final plat to allow construction of 68 single family lots on property legally described as follows: That part of the north half of the southeast quarter of Section 17, Township 31, Range 21, Washington County, Minnesota, described as follows: Beginning at the east quarter corner of said Section 17, said corner is designated by a found Washington County cast iron monument, thence south 89 degrees 32 minutes 46 seconds west, assumed bearing, along the north line of the southeast quarter of said Section 17, a distance of 2095.85 feet to a point designated by a found % inch iron pipe, marked R.L.S. 15835; thence south 00 degrees 12 minutes 54 seconds west 150.01 feet to a point designated by a found % inch iron pipe marked R.L.S. 15835; thence south 89 degrees 32 minutes 46 seconds west 137.95 feet to a point designated by a found iii iron pipe, marked R.L.S. 13590; thence south 00 degrees 27 minutes 14 seconds east 166.10 feet to a point designated by a found % inch iron pipe, marked R.L.S. 9808; thence south 89 degrees 32 minutes 46 seconds west 0.20 feet; thence south 00 degrees 27 minutes 14 seconds east 254.10 feet to a point designated by a found % iron pipe, marked R.L.S. 9808; thence south 89 degrees 32 minutes 46 seconds west 223.39 feet to a point designated by a set % inch iron pipe, marked R.L.S. 13590; thence south 11 degrees 51 minutes 00 seconds west 128.17 feet to a point designated by set 1h inch iron pipe marked R.L.S. 13590; thence north 89 degrees 20 minutes 02 seconds east 440.34 feet to a point designated by a set % inch iron pipe, marked R.L.S. 13590; thence north 00 degrees 39 minutes 58 seconds west 58.47 feet to a point designated by a found % inch iron pipe marked R.L.S. 13590; thence north 89 degrees 44 minutes 51 seconds east 718.93 feet to the east line of the northwest quarter of the southeast quarter of Section 17, thence south 00 degrees 12 minutes 56 seconds west, along said east line, 688.18 feet to southeast comer of the northwest quarter of the southeast quarter, thence north 89 degrees 44 minutes 51 seconds east, along said south line, 1320.06 feet to the southeast corner of said north half of the southeast quarter said point is designated by a found % inch iron pipe, marked R.L.S. 13590; thence north 00 degrees 12 minutes 31 seconds east along the east line of said north % of southeast quarter, 1330.72 feet to the point of beginning; Resolution 2003-25 Page 2 WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE 1T HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for Fegowi Development, Inc. for Oneka Ponds; and FURTHER, that the development agreement for said plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved to allow 68 single family home lots and one outiot, in accordance with the plans received by the City on May 5, 2003, except as amended by this resolution. 2. The development agreement must be executed by the developer and the City prior to release of the final plat. 3. Development standards shall be according to the preliminary plat (Res. 2002-53) approvals granted by the City Council on October 7, 2002. The developer must comply with all conditions of approval prior to issuance of building permits. 4. Approval of the final plat is contingent upon municipal utilities being provided from the west. The timing of that utility extension is unknown at this time. Up to six permits for model homes shall be issued, but no Certificate of Occupancy shall be issued until municipal utilities are available. 5. Oudot A shall be dedicated to the City as the required park dedication. The City will pay the developer $100,000 for the land dedication above the park dedication requirements and the developer agrees to grade the park site and provide the required wetland mitigation. 6. The plat shall be revised to comply with the City's street naming system. 7. A standard drainage and utility easement shall be provided to the City along the north and east property line of the subdivision. The easement will be located over an existing NSP (Xcel Energy) easement identified in Book No. 142, Page 154-155, Doc. No. 3012107 as shown on the plat. The required easement shall be provided and the final plat shall be revised for City review prior to release of the final plat for recording. Resolution 2003-25 Page 3 8. The final plat must be revised to include the drainage and utility easement across Lot 14, Block 2 required per the construction drawings for the emergency overflow from the rear yard area of Block 2. 9. The final plat must be revised to include the required drainage and utility easement across the south end of Lot 29, Block 1 per the construction plan easements over the emergency overflow from the intersection of Goodview Trail North. 10. The final plat shall be revised to include the required drainage and utility easement across Lot 45, Block 1 over the sanitary sewer and watermain. 11. The final plat shall be revised to include the a 30 -foot wide drainage and utility easement between Lots 21 and 22, Block 1 to provide adequate separation for utilities. 12. The applicant shall request a vacation of the existing ponding and flowage easement on the west end of the subdivision. The easement must be vacated prior to release of the final plat. 13. The developer shall work with City staff to coordinate construction with the City ditch project. 14. The developer must obtain all necessary permits from Rice Creek Watershed District. 15. Final utility plans and details must be submitted for review and approval by City staff prior to release of final plat. 16. Final construction plans, including drainage documents, must be submitted for review and approval by City staff prior to release of final plat. ADOPTED by the City Council this 19" day of May 2003.
