APPROVING FINAL PLAT AND DEVELOPMENT AGREEMENT FOR
HERITAGE DEVELOPMENT FOR "EAGLE SHORES" ON PROPERTY
LOCATED NORTH OF 122ND STREET AND WEST OF EVERTON AVENUE
WHEREAS, Heritage Development has requested approval of a final plat to allow
construction of 11 single family lots on property legally described as follows:
Outlots C, H, I and J, Lake Estates, Washington County, Minnesota
WHEREAS, the City has prepared a development agreement covering the improvements
related to said plat;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat for Heritage Development for Eagle Shores; and
FURTHER, that the development agreement for said plat be approved, and that the
Mayor and City Administrator be authorized to execute the development agreement on
behalf of the City; and
FURTHER, that the following conditions be met prior to recording the final plat:
1. A final plat is approved to allow 11 single family home lots and 3 oudots, in
accordance with the plans received by the City on April 24, 2003, except as amended
by this resolution.
2. The development agreement must be executed by the developer and the City prior to
release of the final plat.
3. Development standards shall be according to the PUD general plan (Res. 2003-20)
and preliminary plat (Res. 2003-21) approvals granted by the City Council on April
21, 2003. The developer must comply with all conditions of approval prior to
issuance of building permits.
4. The developer must obtain all necessary permits from Rice Creek Watershed District
and Minnesota Department of Natural Resources, including any MnDNR approvals
for a shared dock on Bald Eagle Lake.
5. The final plat is approved based on the finding that the proposed lots exceed all
minimum lot size standards for the DNR and City of Hugo shoreland requirements.
No density bonuses are requested or approved.
6. The developer shall revise the final plat to provide a 30 -foot drainage and utility
easement on the rear (north) of Lot 3 for a future extension of watermain.
7. The applicant shall provide copies of the HOA documents/covenants for City review
prior to release of the final plat. A copy of the covenants shall be filed with the final
plat.

8. The applicant shall work with staff and the private utility companies to ensure that
adequate space is preserved within the right-of-way/easements for installation of all
utilities and future installation of municipal water.
9. The storm sewer easement needed for extension of the storm sewer outlet west of this
site must be shown on the site plan and preliminary plat.
10. The applicant shall be responsible for obtaining the 30 -foot easement required to
extend the storm sewer system to discharge into Bald Eagle Lake.
11. The plat shall be revised to comply with the City's street naming system.
12. The developer shall comply with all requirements from the City Engineer, prior to
release of the final plat.
13. The developer shall comply with requirements from the City Water Resources
Engineer, prior to release of the final plat.
14. Final construction plans, including drainage documents, must be submitted for review
and approval by City staff prior to release of final plat.
15. Park dedication shall be fees -in -lieu of dedication for the 10 new lots. Park
dedication fees will be due prior to release of the final plat for recording.
16. The applicant may either pay a cash escrow for the future municipal water
improvements, or enter into an assessment agreement for the future improvements.
The assessment agreement, among other things, will require the property to waive all
rights to appeal any future assessments under Minnesota Statues 429.
