APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR EMMERICH
DEVELOPMENT CORPORATION FOR PROPERTY LOCATED ON BOTH
SIDES OF GOODVIEW AVENUE, SOUTH OF 145M AVENUE
WHEREAS, the Emmerich Development Corporation has requested a comprehensive
plan amendment to add property to the Metropolitan Urban Service Area (MUSA), with
respect to the 239 -acre site, legally described as follows:
The south half of the south half of the southeast quarter of the northwest quarter of
Section 21, Township 31, Range 21 together with an easement over the north 33 feet
of the east 1940 feet of the southwest quarter of Section 21, Township 31, Range 21
for purposes of ingress and egress.
AND
The southwest quarter of Section 21, Township 31, Range 21.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request for a comprehensive plan amendment for the above -referenced property, based on
the following findings and subject to the following conditions:
1. Approval of this comprehensive plan amendment is contingent upon, and subject
to, the required review and response by the Metropolitan Council.
2. Approval is contingent upon reconstruction of Goodview Avenue to provide
access to the site.
3. The property is located with the Urban Reserve, which is intended to allow urban
land use pending the availability of municipal services such as sewer and water.
4. The property is unique with regard to its development potential and the
contiguous natural resources such as, jurisdictional wetlands and public waters
that will be protected.
5. The property has proximity to existing urban development and appears to have
predicable, logical development potential.
6. The unique physical characteristics of the site (wetlands and public waters) would
constitute an eastern termination of urbanization. This statement is validated by
the fact that the property is substantially confined or contained by jurisdictional
wetlands and/or public waters.

7. The applicant is proposing to develop the site in a manner that respects the City's
desire to maintain open space, as well as provide a transition between the urban
and rural areas of Hugo. Further, the applicant believes that the proposed site and
development could serve as a "prototype" or demonstration site for similar
properties in Hugo. Lastly, the property is in an area that is ultimately planned for
urban services.
8. There is adequate public infrastructure to serve the site.
9. Approval of the amendment would have no negative fiscal impact upon the City.
