APPROVING PRELIMINARY PLAT FOR EMMERICH DEVELOPMENT
CORPORATION FOR "DIAMOND POINT WEST" ON PROPERTY LOCATED
WEST OF GOODVIEW AVENUE AND SOUTH OF 145m STREET
WHEREAS, Emmerich Development Corporation has requested approval of a
preliminary plat to allow construction of 50 homes on property legally described as
follows:
Government Lot 1, Section 20, Township 31, Range 21.

Government Lot 2, Section 20, Township 31, Range 21, except the following 5
parcels:
1. That part platted as Rice Lake Meadows.
2. That part platted as Rice Lake Meadows 2"d Addition.
3. That part platted as Rice Lake Meadows P Addition.
4. That part platted as Rice Lake Meadows 0 Addition.
5. All that part of Government Lot 2, Section 20, Township 31, Range 21,
Washington County, Minnesota, lying west of the east 1321 feet and lying
southerly of the following described line:
Commencing at the point of intersection of the north line of said Government Lot
2 with the west line of the east 1321 feet of said Government Lot 2; thence
southerly along said west line of the east 1321 feet, 303 feet to the point of
beginning of the line to be described; thence northwesterly, angle to the left to 85
degrees 15 minutes a distance of 483.11 feet; thence northwesterly, angle to the
left 170 degrees 12 minutes 52 seconds, a distance of 450 feet, more or less to the
shore of Egg Lake and there terminating.
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called
Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Emmerich Development Corporation for a preliminary plat, subject to the
following conditions:
1. A preliminary plat is approved to allow the creation of 50 single family lots and 3
outlots, in accordance with the plans and application received by the City on May 6,
2003, except as amended by this resolution.
2. Approval is contingent upon the Goodview Avenue reconstruction.

3. Approval is contingent upon City Council approval of the Comprehensive Plan
amendment, the PUD general plan and rezoning from R-3 to PUD.
4. Development standards shall be as approved as part of the PUD.
5. The applicant shall provide copies of the HOA documents/covenants for City review.
A copy of the covenants shall be filed with the final plat.
6. The HOA documents shall ensure that the private open space is preserved.
7. Sidewalks or trails shall be provided according the Park Commission
recommendation.
8. The developer shall provide details for landscaping, decorative street lighting and
signage. The information shall be submitted for City review prior to approval of the
final plat.
9. A master sign plan for the development shall be submitted for City review and
approval.
10. The right-of-way for all public streets shall be as indicated on the approved plans.
11. Public streets within the development shall be 30 feet in width (back to back).
12. The plat shall comply with the City's street naming system.
13. A temporary turnaround shall be provided on the south end of the street.
14. The developer must obtain all necessary permits from Rice Creek Watershed District
and Minnesota Department of Natural Resources.
15. The development shall comply with the Fire Chiefs requirements regarding fire flow
calculations, the location of fire hydrants, fire department connections, and fire lane
signage.
16. The developer shall comply with all City requirements as noted in the comments from
the City water resource engineer and the City Engineer.
