APPROVING PRELIMINARY PLAT FOR EMMERICH DEVELOMENT
CORPORATION FOR `DIAMOND POINT EAST" ON PROPERTY LOCATED
ON EAST OF GOODVIEW AVENUE AND SOUTH OF 145m STREET
WHEREAS, Emmerich Development Corporation has requested approval of a
preliminary plat to allow construction of 125 homes on property legally described as
follows:
The south half of the south half of the southeast quarter of the northwest quarter
of Section 21, Township 31, Range 21 together with an easement over the north
33 feet of the east 1940 feet of the southwest quarter of Section 21, Township 31,
Range 21 for purposes of ingress and egress.

WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called
Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL. OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Emmerich Development Corporation for a preliminary plat, subject to the
following conditions:
1. A preliminary plat is approved to allow the creation of 125 single family lots and 2
outlots, in accordance with the plans and application received by the City on May 6,
2003, except as amended by this resolution.
2. Approval is contingent upon the Goodview Avenue reconstruction. Goodview
Avenue shall be constructed prior to approval of the final plat.
3. Approval is contingent upon City Council approval of the Comprehensive Plan
amendment, the PUD general plan and rezoning from R-3 to PUD.
4. Development standards shall be as approved as part of the PUD.
5. The land proposed for park dedication shall be deeded to the City with the final plat
for the first phase of the development.
6. The applicant shall provide copies of the HOA documents/covenants for City review.
A copy of the covenants shall be filed with the final plat.
7. The HOA documents shall ensure that the private open space is preserved.

8. Sidewalks or trails shall be provided according the Park Commission
recommendation.
9. The developer shall provide details for landscaping, decorative street lighting and
signage. The information shall be submitted for City review prior to approval of the
final plat.
10. A master sign plan for the development shall be submitted for City review and
approval.
11. The right-of-way for all public streets shall be as indicated on the approved plans.
12. Public streets within the development shall be 30 feet in width (back to back).
13. The plat shall comply with the City's street naming system.
14. Cross access and maintenance agreements shall be recorded with the final plat for all
shared driveways.
15. The developer must obtain all necessary permits from Rice Creek Watershed District
and Minnesota Department of Natural Resources.
16. The development shall comply with the Fire Chief s requirements regarding fire flow
calculations, the location of fire hydrants, fire department connections, and fire lane
signage.
17. The developer shall comply with all City requirements as noted in the comments from
the City water resource engineer and the City Engineer.
