HomeMy WebLinkAbout2003.06.16 RESO 2003-0035RESOLUTION 2003-35 APPROVING A PUD GENERAL PLAN FOR EMMERICH DEVELOPMENT CORPORATION FOR ,,°DIAMOND POINT EAST" AND "DIAMOND POINT WEST" ON PROPERTY LOCATED ON BOTH SIDES OF GOODVIEW AVENUE AND SOUTH OF 145m STREET WHEREAS, Emmerich Development Corporation has requested approval of a PUD general plan to allow construction of 175 homes on property legally described as follows: And The south half of the south half of the southeast quarter of the northwest quarter of Section 21, Township 31, Range 21 together with an easement over the north 33 feet of the east 1940 feet of the southwest quarter of Section 21, Township 31, Range 21 for purposes of ingress and egress. M1. The southwest quarter of Section 21, Township 31, Range 21. Government Lot 1, Section 20, Township 31, Range 21. �b Government Lot 2, Section 20, Township 31, Range 21, except the following 5 parcels: 1. That part platted as Rice Lake Meadows. 2. That part platted as Rice Lake Meadows 2nd Addition. 3. That part platted as Rice Lake Meadows P Addition. 4. That part platted as Rice Lake Meadows 0 Addition. 5. All that part of Government Lot 2, Section 20, Township 31, Range 21, Washington County, Minnesota, lying west of the east 1321 feet and lying southerly of the following described line: Commencing at the point of intersection of the north line of said Government Lot 2 with the west line of the east 1321 feet of said Government Lot 2; thence southerly along said west line of the east 1321 feet, 303 feet to the point of beginning of the line to be described; thence northwesterly, angle to the left to 85 degrees 15 minutes a distance of 483.11 feet; thence northwesterly, angle to the left 170 degrees 12 minutes 52 seconds, a distance of 450 feet, more or less to the shore of Egg Lake and there terminating. WHEREAS, the Planning Commission has reviewed the PUD general plan at a duly called Public Hearing and recommends approval, and; Resolution 2003-35 f Page 2 NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCEL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Emmerich Development Corporation for a PUD general plan, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 175 single family lots 5 outlots, in accordance with the plans and application received by the City on May 6, 2003, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested comprehensive plan amendment, rezoning and preliminary plats. 3. The PUD general plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 4. Development standards for the PUD shall be as indicated on the plans dated May 6, 2003, except as amended by this resolution. 5. The applicant shall provide copies of the HOA documents/covenants for City review. 6. The applicant shall develop and implement architectural review and design guidelines for all residential buildings. The guidelines must be submitted for City review and approval. 7. The typical lot detail should be revised to reflect the requested and approved setback requirements. 8. All platted residential lots shall comply with the following setbacks: Minimum lot width 80 feet Minimum lot width for detached townhomes in Diamond Point East 60 feet Minimum front yard setbacks 25 feet Minimum side yard setbacks 10 feet Minimum rear yard setbacks 30 feet Setback around the perimeter of the site (exterior property lines) 3 e Setback from OHW of Egg Lake 75 feet Setback from OHW of Rice Lake 150 feet Maximum Impervious Surface Area 25% Architectural and Design standards 9. The developer shall submit a design palette for entire project for City review and approval. The palette shall include colors for siding, shakes, shutters, shingles, brick Resolution 2003-35 Page 3 and stone. Building colors and materials shall be harmonious throughout the development. 10. All building elevations shall receive nearly equal treatment and visual qualities. 11. No adjacent home shall have the same front elevation colors or architectural styles. Materials shall be consistent with the architectural plans and design palette required as part of the PUD approvals. Landscaping and Lighting 12. At least one overstory deciduous shade tree shall be planted in the front yard of each single family home. 13. The developer shall provide a landscaping plan for the proposed landscaped median on 145th Street for City approval. A mix of boulevard canopy trees, ornamental trees, perennials and annuals should also be provided in the median. 14. Irrigation should be provided for the parkway landscaping. 15. The HOA shall be responsible for maintenance of the 145th Street median landscaping and irrigation. 16. The developer shall provide details for the monument sign and landscaping proposed for the development entrance. This information shall be submitted for staff review and approval prior to final plat. 17. The applicant shall work with the City to finalize the design of the decorative lighting that will be installed. The applicant shall provide the streetlights in compliance with City Policy. 18. Exterior lighting shall be consistent throughout the development. All lighting shall be shielded to prevent glare and light trespass, as required by Section 6.37 of the ordinance. Lighting details should be submitted for City review and approval. 19. A master sign plan for the development shall be submitted for City review and approval. 20. Any development related signage shall be located on the residential lots, not on public park land or public open space land. 21. The applicant shall preserve as many trees as possible on site. Tree preservation fencing must be provided and should be shown on the grading plans. . Resolution 2003-35 Page 4 Streets, Parking and Utilities 22. The developer and the City shall work together to ensure completion of Goodview Avenue. Approval of this development is contingent upon reconstruction of Goodview Avenue. 23. The developer should work with the City to address alignment and access issues at CSAH 8 and Goodview Avenue as part of the reconstruction of this segment of Goodview Avenue. 24. No building permits shall be issued until reconstruction of Goodview has begun. 25. The developer shall work with the City to redesign Goodview Avenue. The street construction shall be phased to coordinate with the improvements to the trunk drainage system. 26. The plat shall be revised to comply with the City's street naming system. 27. Public streets within the development shall be 30 feet in width (back to back). 28. The maximum driveway curb cut width shall be 24 feet. 29. Cross access and maintenance agreements shall be recorded with the final plat for all shared private driveways or streets. 30. Drainage and utility easements shall be recorded with the final plat for all private drives. 31. A temporary turn around shall be provided on the south end of the street in Diamond Point West. 32. The development shall comply with the Fire Chief s requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. 33. The applicant shall comply with all conditions in the City Engineer's letter. 34. The existing well and septic shall be abandoned and municipal utilities shall be extended to serve this property in the first phase of development. . Resolution 2003-35 ' Page 5 Sidewalks and Trails 35. Sidewalks and trails shall be provided in compliance with the Park Commission recommendations. 36. The HOA shall be responsible for maintenance of sidewalks within the development. Parks/Open Space 37. The land proposed for park dedication shall be deeded to the City with the final plat for the first phase of the development. 38. The HOA documents shall ensure that private open space shall be preserved. Drainage/Stormwater Management 39. The applicant shall obtain approval of the land development plan by the Rice Creek Watershed District, including the proposed wetland impacts and mitigation. 40. Prior to final plat approval, the applicant must receive all City and watershed approvals for the storm water drainage system. Construction of the required drainage improvements shall be coordinated with improvement to the trunk drainage system. 41. The minimum floor elevation shall comply with Section 1175-060.1 of the Hugo Zoning Ordinance. The applicant shall provide minimum floor elevations for all units to ensure compliance with City requirements. 42. The applicant shall provide a wetland mitigation plan for City review. 43. The applicant shall comply with all conditions from the City water resources engineer letter dated May 5, 2003. Shoreland Management 44. The developer must obtain all necessary permits from Rice Creek Watershed District and Minnesota Department of Natural Resources. 45. The final plat is approved based on the finding that the proposed lots comply with the density standards of the City of Hugo and the shoreland requirements. No density bonuses are requested or approved. 46. PUD flexibility is approved to for development within the shoreland overlay district, based on the following findings: . Resolution 2003-35 • Page 6 a. Staff finds that the proposed development is exempt from the DNR PUD standards which would require 50 percent open space, based on the finding that the DNR rules apply to developments in which a Conditional Use Permit is required for the PUD. The City would not require a conditional use permit for this development. Therefore, the City will review the application according the shoreland regulations adopted as part of the Hugo Zoning Ordinance. b. The City has an adopted stormwater management program that reduces the need for the larger lots and increased setbacks, which are intended to reduce runoff into the lakes. The stormwater management program adequately addresses this issue. c. Additionally, the applicant has indication that restrictive covenants will be part of the Association documents and these covenants will prohibit the placement of docks or any disturbance below the delineated wetland line of the lake. d. The structure setback from the Rice Lake will be increased to a minimum of 187 feet from the OHWL. e. The applicant is proposing to provide permanent open space within the development that will be maintained by the HOA. This will help to preserve the natural features of the site and will increase the pervious areas on site. f. The applicant is providing 152.90 acres of permanent open space and park land within this 239 -acre site. This permanent open space would mitigate any effects of the flexibility requested by the applicant. g. The total impervious surface within the development will be less than 25 percent. h. The developer will implement BMPs (Best Management Practices) to ensure adequate protection of the lake during construction. i. The master plan for this development would comply with the purpose and intent of the shoreland requirements, which is to preserve the quality of the adjacent lakes.
