APPROVING A PRELIMINARY AND FINAL PLAT, CONDITIONAL USE
PERMIT, AND VARIANCE FOR SOLID GROUND DEVELOPMENT FOR
PROPERTY LOCATED EAST OF HIGHWAY 61 BETWEEN 1474 STREET
AND 148 STREET
WHEREAS, Solid Ground Development has requested approval of a preliminary and
final plat, conditional use permit, and variance to allow 10 townhome lots and common
lots on property legally described as follows:

WHEREAS, the Planning Commission has reviewed the preliminary plat, conditional use
permit, and variance at a duly called Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
preliminary and final plat, conditional use permit, and variance for Solid Ground
Development, subject to the following conditions:
1. A preliminary and final plat, conditional use permit, and variance is approved to
allow the creation of 10 townhome lots and four outlots in accordance with the plans
and application received by the City on June 9, 2003, except as amended by this
resolution.
2. Development standards shall be as required by the CR -4 district.
3. The applicant shall revise the site plan to eliminate the parking stalls adjacent to 147`"
Street.
4. The final plat shall include 10 additional feet of right-of-way along 147'' Street.
5. The developer shall comply with all conditions from the City engineer.
6. The developer shall provide the City with a copy of the homeowner's association
documents to ensure maintenance of the required common open space.
7. The homeowner's association documents shall include language to ensure that the
enclosed garage spaces are maintained for vehicle parking and that parking of
snowmobiles, boats, RVs and other recreational vehicles in the driveway is
prohibited. The covenants should be drafted to prohibit the storage of anything in the
garage or driveway that would prevent the storage and parking of vehicles in the
garages.

8. Prior to recording the final plat, the developer shall pay the park dedication fees in
lieu of land dedication, pursuant to the Dedication Policy in effect at the time of
recording the final plat.
