APPROVING FINDINGS OF FACT FOR REZONING FROM AGRICULTURAL
TO LONG TERM AGRICULTURAL AND CERTIFYING PROPERTY
ELIGIBLE FOR DESIGNATION AS AGRICULTURAL PRESERVE FOR
PROPERTY LOCATED NORTH OF COUNTY ROAD 57 AND EAST OF
JEFFREY AVENUE
WHEREAS, Edmund Tschida has requested reclassification of the zoning from
Agricultural to Long Term Agricultural for an 80 -acre parcel, legally described as
follows:
The West 1/2 of the Northeast 1/a, Section 13, T31N-R21W, Washington County,
Minnesota.
WHEREAS, the Planning Commission has reviewed the rezoning at a duly called Public
Hearing and recommends approval of the rezoning, and;
WHEREAS, the Planning Commission fmds that the property should be certified eligible
for designation as agricultural preserve, and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from
Agricultural to Long Term Agricultural; and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL, OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does certify the
property eligible for designation as agricultural preserve and approves the reclassification
of the zoning from Agricultural to Long Term Agricultural, based on the following
findings:
1. The proposed rezoning is consistent with the Comprehensive Plan and other City
policies and plans, because the rezoning would help preserve agricultural land in an
area of the City designated as permanent rural.
2. The property is eligible for inclusion in the Metropolitan Agricultural Preserves
program as outline in Section 473H of the State Statutes.
3. The property contains a single family home, agriculture land, and vacant natural
areas. These land uses are consistent with the proposed zoning.
4. The proposed development meets the intent of the Long Term Agricultural district by
preserving a parcel greater than 40 acres for future agricultural and open space use.
ADOPTED by the City Council this 3rd day of Novem 003.
