APPROVING FINDINGS OF FACT DENYING A COMPREHENSIVE PLAN
AMENDMENT AND REZONING FOR PROPERTY LOCATED WEST OF FENWAY
AVENUE, SOUTH OF 140 STREET, AND NORTH OF THE TOWNHOMES OF
BALD EAGLE LAKE (TSCHIDA AND MOLITOR PROPERTIES)
WHEREAS, the City of Hugo initiated a Comprehensive Plan Amendment and Rezoning to
change the zoning from Multi -Family to General Industrial for property located west of Fenway
Avenue, south of 140x` Street, and north of the Townhomes of Bald Eagle Lake (Tschida and
Molitor properties); and,
WHEREAS, the subject property is legally described as follows:
NE %, NE % and the SE V4, NE Y4 and the NE '/ , SE %, all within Section 30 T31N-
R21 W.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends denial; and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does deny the rezoning from Multi -Family
and Urban Residential to General Industrial, based on the following findings:
1. Rezoning the subject property to General Industrial would make it difficult to adequately
buffer the adjacent residential homes.
2. The City's General Industrial district allows a variety of high intensity uses that could
have adverse impacts on nearby residential properties.
3. Rezoning the subject property to General Industrial may result in greater tree removal
than if the property were developed with residential uses, because industrial
developments generally require larger building pads and large parking lot areas.
4. The physical characteristics of the property, including the location of wetland, floodplain,
and steep slopes, are not conducive to large industrial buildings.
