RESOLUTION 2002-11
APPROVING A PRELIMINARY PLAT FOR KEL-MONT, LLC FOR
WILDERNESS VIEW ON PROPERTY LOCATED SOUTH OF 130M STREET,
WEST OF GOODVIEW AVENUE AND EAST OF FOX HILL AVENUE
WHEREAS, Kel-Mont LLC has requested approval of a preliminary plat to allow
construction of eleven single family lots on property legally described as follows:
Parcel I
The west half of the northeast quarter of Section 32, Township 31, Range 21, Washington
County, Minnesota
Parcel 2
The north half of the southeast quarter of the northeast quarter of Section 32, Township
31, Range 21, Washington County, Minnesota.
Parcel 3
The west half of the west half of the south half of the southeast quarter of the northeast
quarter of Section 32, Township 31, Range 21, Washington County, Minnesota.
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called
Public Hearing and recommends approval, and;
NOW, THEREFORE, BE- IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
preliminary plat for Kel-Mont LLC on property located south of 130' Street, west of
Goodview Avenue and east of Fox Hill Avenue, subject to the following conditions:
1. A preliminary plat is approved to allow the creation of eleven single family lots and
one outlot, in accordance with the plans and application received by the City on
February 1, 2002, except as amended by this resolution.
2. Development standards shall be as required by the R-3 district. No variances are
granted or implied.
3. The area identified as Outlot A, located between Lot 4, Block 2 and Lot 5, Block 3
shall be removed and the property shall be platted as part of the adjacent lots. A 45 -
foot easement shall be provided to the City for drainage and utilities and the trail.
4. The area identified as Outlot B shall be removed and shall be platted as part of the
adjacent lots. A 30 -foot drainage and utility easement shall be provided to the City.
5. The cul-de-sac radius shall be reduced from a 50 -foot to a 45 -foot radius.
6. The site plan notes that the right-of-way is 66 feet, but the actual distance is 60 feet.

7. The pavement width shall be 30 feet measured back of curb to back of curb.
8. The maximum driveway curb cut width shall be 24 feet.
9. The developer shall construct the City trail between Lot 4, Block 2 and Lot 5, Block
3. The trail shall be constructed to City standards and shall be extended to the east
property line of Wilderness View.
10. The developer shall provide landscaping, in accordance with Section 1175-140.1,
Subd. 15 of the Zoning Ordinance. One deciduous overstory shade tree is required in
the front yard of each home site.
11. The developer must extend sewer and water to the east boundary of the Wilderness
View plat.
12. The developer should provide survey data adjacent to the pond outlet to verify that
the proposed system can discharge at the elevation indicated on the plans.
13. The developer must obtain all necessary permits from Rice Creek Watershed District
prior to final plat approval.
14. The lowest floor shall be at least two feet above the high water elevation of the storm
water pond and wetland.
15. A soil boring shall be provided for each lot at the time of building permit application.
16. Prior to recording the final plat, the developer shall pay the park dedication fees in
lieu of land dedication, pursuant to the Dedication Policy in effect at the time of
recording the final plat.
17. The applicant shall correct the erosion problem on the west side of the property by
establishing a 3:1 slope and providing the appropriate vegetative cover.
