FOR VICTOR GARDENS 2"d ADDITION ON PROPERTY LOCATED SOUTH OF CSAH 8 AND EAST OF EXISTING ELMCREST AVENUE NORTH WHEREAS, Pratt -Amt -Oakwood, LLC. has requested approval of a preliminary plat to allow construction of 70 townhome units on property legally described as follows: Insert Legal WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the preliminary plat for Pratt Amt -Oakwood, LLC on property located south of CSAH 8 and east of Elmcrest Avenue, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 70 units and two outlots, in accordance with the plans and application received by the City September 28, 2001 and May 10, 2002, except as amended by this resolution. 2. A 30 -foot minimum setback shall be required around the outside perimeter of the site. 3. Boulevard trees shall be planted along both sides of all local streets. The trees shall be planted at a minimum of 50 feet on -center. 4. Exterior lighting shall be consistent throughout the development. All lighting shall be shielded to prevent glare and light trespass, as required by Section 6.37 of the ordinance. Streets, Sidewalks and Utilities 5. The intersection with CSAR 8 will not generate enough traffic to warrant a traffic signal with the second phase of the development. The need for a traffic signal will be reviewed with each subsequent phase or earlier if there is a documented traffic or safety problem at the intersection. The applicant is responsible for the full cost of a temporary signal or two legs of a permanent signal. 6. Cross access and maintenance agreements shall be recorded with the final plat for all shared private driveways. 7. The development shall comply with the Fire Chiefs requirements regarding fire flow calculations, the location of fire hydrants, fire department connections, and fire lane signage. The applicant shall obtain approval of the land development plan by the Rice Creek Watershed District, including the proposed wetland impacts and mitigation. 9. A portion of the development lies within the Floodplain Overlay District. The developer shall obtain all necessary permits and approvals for the floodplain impacts.
