HomeMy WebLinkAbout2002.06.17 RESO 2002-0027CJ M k-1IZI)a4� APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR KEL- MONT, LLC FOR WILDERNESS VIEW ON PROPERTY LOCATED SOUTH OF 130TH STREET, WEST OF GOODVIEW AVENUE AND EAST OF FOX HILL AVENUE WHEREAS, Kel-Mont LLC has requested approval of a final plat to allow construction of eleven single-family lots and one outlot on property legally described as follows: Parcel I The west half of the northeast quarter of Section 32, Township 31, Range 21, Washington County, Minnesota Parcel 2 The north half of the southeast quarter of the northeast quarter o} Section 32, Township 31, Range 21, Washington County, Minnesota. Parcel 3 The west half of the west half of the south half of the southeast quarter of the northeast quarter of Section 32, Township 31, Range 21, Washington County, Minnesota. WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for Kel-Mont LLC for Wilderness View; and FURTHER, that the development agreement for said plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and, FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved to allow the creation of eleven single family lots and one outlot, in accordance with the plans received by the City on May 10, 2002, and revisions received on June 3, 2002, except as amended by this resolution. 2. The development agreement must be executed by the developer and the City prior to release of the final plat for filing. 3. Development standards shall be as required by the R-3 district. No variances are granted or implied. Resolution 2002-27 Page 2 4. A 35 -foot easement shall be provided to the City for drainage and utility purposes between Lot 5 and Lot 6, Block 1. 5. A 35 -foot easement shall be provided to the City for trail purposes between Lot 5 and Lot 6, Block 1. 6. The developer shall construct the City trail between Lot 5 and Lot 6, Block 1. The trail shall be constructed to City standards and shall be extended to the east property line of Wilderness View. 7. A 40 -foot easement shall be provided to the City for drainage and utility purposes between Lot 9 and Lot 10, Block 1. 8. Prior to recording the final plat, the developer shall submit all required easements as approved by the City Engineer. 9. Grading, drainage and utility plans are subject to final review and approval by the City Engineer. 10. Prior to recording the final plat, the developer shall pay the park dedication fees in lieu of land dedication, pursuant to the Dedication Policy in effect at the time of recording the final plat. 11. No building permits shall be issued until the final plat is filed. 12. The developer must provide written disclosure to potential landowners that the backyard area on these lots is limited. Potential landowners shall be notified that decks, patios and other similar features will not be permitted in the wetland or in the drainage and utility easements.
