HomeMy WebLinkAbout2002.06.17 RESO 2002-0028RESOLUTION 2002-28 APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR CENTEX HOMES FOR CLEARWATER CREEK ON PROPERTY LOCATED WEST OF FENWAY BOULEVARD AND NORTH OF 132ND STREET NORTH WHEREAS, Centex Homes has requested approval of a final plat to allow construction of eighteen condominium lots and three outlots on property legally described as follows: Outlot B, Woods of Bald Eagle Lake, according to the recorded plat thereof, Washington County, Minnesota, except that part platted as Townhomes of Bald Eagle Lake, according to the recorded plat thereof, Washington County, Minnesota. WHEREAS, the City has prepared a development agreement covering the improvements related to said plat; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final plat for Centex Homes for Clearwater Creek; and FURTHER, that the development agreement for said plat be approved, and that the Mayor and City Administrator be authorized to execute the development agreement on behalf of the City; and, FURTHER, that the following conditions be met prior to recording the final plat: 1. A final plat is approved to allow the creation of eighteen condominium lots and three outlots, in accordance with the plans received by the City on May 23, 2002 and June 6, 2002, except as amended by this resolution. 2. The development agreement must be executed by the developer and the City prior to release of the final plat for filing. 3. Development standards shall be as required by the R-5 district, except as otherwise noted in the site plan and variance approvals granted by the City Council on April 15, 2002. 4. An 8 -foot bituminous trail shall be provided in the locations shown on the plans. The developer shall provide a trail easement to ensure that a minimum of six feet of planting space is retained in the boulevard between the trail and the street. The plans shall be revised accordingly. 5. The developer shall construct the City trail. The trail shall be constructed to City standards. R - y Resolution 2002-28 Page 2 6. Prior to recording the final plat, the developer shall submit all required easements as approved by the City Engineer. 7. Prior to recording the final plat, the developer shall pay the park dedication fees in lieu of land dedication, pursuant to the Dedication Policy in effect at the time of recording the final plat. 8. No park dedication credit shall be given for dedication of Outlot A. 9. Grading, drainage and utility plans are subject to final review and approval by the City Engineer. 10. Prior to issuance of building permits, the developer shall provide a proof of parking plan for staff review. ADOPTED by the City Council this 17th day of June 2002. on, Mayor ATTEST: k'e City Clerk
