RESOLUTION 2002-32
APPROVING FINDINGS OF FACT FOR REZONING FOR KETTLER
CONSTRUCTION FOR PROPERTY LOCATED AT THE NORTHWEST
QUADRANT OF THE INTERSECTION OF FENWAY BOULEVARD AND THE
FUTURE 140TH STREET NORTH
WHEREAS, Kettler Construction has requested reclassification of the zoning from R-3
(single family detached residential) to PUD (planned unit development) for a 17.33 -acre
parcel, legally described as follows:
Parcel 1: Part of the southeast % of the southeast % of Section 19, Township 31,
Range 21, being the north 310 feet of the south 670 feet of the west 687.58 feet of
the east 787.58 feet.
Parcel 2: Part of the southeast % of the southeast % of Section 19, Township 31,
Range 21, being the south 515 feet except the north 155 feet of the east 787.58
feet and except the east 50 feet of the north 327 feet of the south 360 feet thereof.
WHEREAS, the Planning Commission has reviewed the site plan at a duly called Public
Hearing and recommends approval, and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from
R-3 to PUD;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request
by Kettler Construction for the reclassification of the zoning from R-3 to PUD for a 17.33
acre property located at the northwest quadrant of the intersection of Fenway Boulevard
and the future 140 Street, based on the following findings:
1. The proposed rezoning is consistent with the Comprehensive Plan and other City
policies and plans.
2. The proposed development meets the intent of the PUD zoning district by providing
an efficient use of land by using reduced street width and reduced building setbacks
to preserve wetlands.
3. The proposed development meets the intent of the PUD zoning district by providing
lifecycle -housing opportunities for single -level living in the planned twinhomes.

4. The proposed development meets the intent of the PUD zoning district by creating an
integrated twinhome neighborhood and preservation of natural resources that that
would not otherwise be possible through a strict interpretation of the Zoning
Ordinance.
5. The development would incorporate common design elements. The buildings would
have common design elements and landscape materials throughout the development.
6. There is adequate infrastructure to support the proposed rezoning and development.
The developer has proposed to provide a lift station north of 140`h Street to serve this
development.
7. The developer is responsible for the full cost of the lift station construction.
ADOPTED by the City Council this 1st day of July 2002.
