HomeMy WebLinkAbout2002.07.01 RESO 2002-0033V CITY OF HUGO RESOLUTION 2002-33 APPROVING A PUD GENERAL PLAN FOR KETTLER CONSTRUCTION FOR PROPERTY LOCATED AT THE NORTHWEST QUADRANT OF THE INTERSECTION OF FENWAY BOULEVARD AND THE FUTURE 140TH �1 g.7 D1 -*&111114 9 ,_1 WHEREAS, Kettler Construction has requested approval of a PUD general plan for property legally described as follows: Parcel 1: Part of the southeast % of the southeast % of Section 19, Township 31, Range 21, being the north 310 feet of the south 670 feet of the west 687.58 feet of the east 787.58 feet. Parcel 2: Part of the southeast % of the southeast % of Section 19, Township 31, Range 21, being the south 515 feet except the north 155 feet of the east 787.58 feet and except the east 50 feet of the north 327 feet of the south 360 feet thereof. WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Kettler Construction for a PUD general plan, subject to the following conditions: 1. The PUD general plan for construction of a 34 -unit twinhome development with two outlots and two common lots is approved in accordance with the application and plans received by the City on March 15, 2002, and revisions received May 31, 2002, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested rezoning and preliminary plat. 3. The PUD general plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 4. Development standards for the PUD shall be as indicated on the plans dated May 31, 2002, except as amended by this resolution. 41 Resolution 2002-33 Page 2 5. The following structural setbacks shall apply: a. 25 feet from all public streets b. 10 feet from the north property line 6. The maximum driveway curb cut width shall be 24 feet. 7. The internal public street shall be permitted with a 50 -foot right of way and 28 - foot wide paved surface. 8. The right-of-way shown for Carl's Circle shall be eliminated and platted as part of the adjacent Outlot B property. 9. The developer shall provide, a trail easement between the southern cul de sac and the planned trail on 140th Street. The 30 -foot trail easement shall be located between Lot 16 and Lot 17, Block 1. A trail shall be constructed when the trail on 140`h Street is constructed. 10. When 140th Street is constructed, a trail will be constructed on the north side of the street as shown on the applicant's plans. 11. The developer is responsible for the full cost of the lift station construction. 12. The plans shall note the ordinary high water and 100 -year high water elevation for all water bodies. 13.
