HomeMy WebLinkAbout2002.08.05 RESO 2002-0039RESOLUTION 2002-39 APPROVING FINDINGS OF FACT FOR REZONING FOR LAKEVIEW HUGO LLP FOR PROPERTY LOCATED EAST OF ELMCREST AVENUE, WEST OF FENWAY BOULEVARD, NORTH OF 130M STREET AND SOUTH OF 140M STREET WHEREAS, Lakeview Hugo LLP has requested reclassification of the zoning from R-3 (single family detached residential) and R-1 (large lot single family residential) to PUD (planned unit development) for a 102 -acre parcel, legally described as follows: The Northeast Quarter of the Southwest Quarter of Section 30, Township 31, Range 21, Washington County, Minnesota\ And The Southeast Quarter of the Northwest Quarter of Section 30, Township 31, Range 21, Washington County, Minnesota. And Outlot B, WOODS OF BALD EAGLE LAKE, according to the recorded plat thereof, Washington County, Minnesota, EXCEPTING THEREFROM that part of said Outlot B, platted as TOWNHOMES OF BALD EAGLE LAKE, according to the recorded plat thereof, said Washington County. EXCEPT that part lying easterly of the following described line and its southeasterly extension: Commencing at the northwest corner of said Outlot B; thence south 89 degrees 00 minutes 36 seconds East, assumed bearing along north line of said Outlot B, a distance of 255.07 feet to the point of beginning of the line to be described; thence South 07 degrees 42 minutes 04 seconds West, a distance of 556.10 feet; thence South 09 degrees 39 minutes 58 seconds West, a distance of 213.94 feet; thence South 77 degrees 49 minutes 38 seconds East, a distance of 253.66 feet; thence South 55 degrees 55 minutes 49 seconds East, a distance of 358.46 feet; thence South 19 degrees 29 minutes 44 seconds West, a distance of 241.35 feet; thence Southeasterly along a non-tangential curve concave to the southwest, having a central angle of 36 degrees 22 minutes 35 seconds and a radius of 140.00 feet for an arc distance of 88.88 feet, the chord of said curve bears South 52 degrees 18 minutes 59 seconds east; thence South 34 degrees 07 minutes 41 seconds East, tangent to said curve, a distance of 34.69 feet to the north line of Lot 22, Block 7, said TOWNHOMES OF BALD EAGLE LAKE and said line terminating. FJ Resolution 2002-39 Page 2 And That part of the Southwest Quarter of the Northwest Quarter of Section 30, Township 31 North, Range 21 West, Washington County, Minnesota, described as follows: Commencing at the southwest comer of said Southwest Quarter of the Northwest Quarter thence North 0 degrees 36 minutes 23 seconds West, assumed bearing along the west line of said Southwest Quarter of the Northwest Quarter, 300.00 feet to the point of beginning of the parcel to be described; thence South 89 degrees 32 minutes 20 seconds East, 1470 feet, more or less to the east line of said Southwest Quarter of the Northwest Quarter, thence northerly along said east line, 312 feet, more or less, to the north line of the South 604.68 West of said Southwest Quarter of the Northwest Quarter, thence westerly along said north line, 1287 feet, more or less, to the enter line of Elmcrest Avenue North; thence southeasterly, along said center line, 366 feet, more or less to the point of beginning. Subject to Elmcrest Avenue North, This tract contains 10.00 acres, more or less. Subject to and together with any other valid easements, restrictions and reservations. WHEREAS, the Planning Commission has reviewed the site plan at a duly called Public Hearing and recommends approval, and; WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from R-3 and R-1 to PUD; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request by Lakeview Hugo LLP for the reclassification of the zoning from R-3 and R-1 to PUD for a 102 -acre property located east of Elmcrest Avenue, west of Fenway Boulevard, north of 130" Street and south of 140" Street, based on the following findings: 1. The proposed rezoning is consistent with the Comprehensive Plan and other City policies and plans. The development would allow single-family detached homes at a net density of 1.44 units per acre, which is consistent with the Comprehensive Plan and Zoning Ordinance requirements. 2. The proposed development meets the intent of the PUD zoning district by providing an efficient use of land by using reduced street widths and smaller lots on the eastern portion of the site to preserve wetlands and provide larger, estate lots on the western portion of the site. The proposed development meets the intent of the PUD zoning district by creating an integrated neighborhood, lifecycle housing opportunities and preservation of natural resources that that would not otherwise be possible through a strict interpretation of the Zoning Ordinance. 4. The PUD would allow the developer to provide single family homes on smaller lots in the eastern portion of the site to provide a transition between the townhomes on the east and the larger single family home lots proposed in the western portion of this site. 5. The development would incorporate common design elements. The buildings would have common design elements and similar landscape materials would be used throughout the development. 6. There is adequate infrastructure to support the proposed rezoning and development. The developer has proposed to provide a lift station to serve this development and the developer will be responsible for the full cost of the lift station construction.
