HomeMy WebLinkAbout2002.08.05 RESO 2002-0040RESOLUTION 200240 APPROVING A PUD GENERAL PLAN FOR LAKEVIEW HUGO LLP FOR PROPERTY LOCATED EAST OF ELMCREST AVENUE, WEST OF FENWAY BOULEVARD, NORTH OF 130TH STREET AND SOUTH OF 140TH STREET WHEREAS, Lakeview Hugo LLP has requested approval of a PUD general plan for property legally described as follows: Insert Legal WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the request by Lakeview Hugo LLP for a PUD general plan, subject to the following conditions: 1. The PUD general plan for 52 single family detached home lots with three outlots is approved in accordance with the application and plans received by the City on June 13, 2002 and revisions received on June 28, 2002 and July 2, 2002, except as amended by this resolution. 2. Approval is contingent upon City Council approval of the requested rezoning and preliminary plat. 3. The PUD general plan is approved based on the finding that the proposed project is consistent with the City's Comprehensive Plan. 4. Development standards for the PUD shall be as indicated on the plans dated July 2, 2002, except as amended by this resolution. 5. Structure setbacks shall be as follows: ■ 30 -foot front yard setback ■ 10 -foot side yard house setback ■ 6 -foot side yard garage setback ■ 30 -foot rear yard setback ■ 50 -foot setback from the OHW of Clearwater Creek 6. The developer shall comply with the Shoreland District standards outlined in Section 1155-020.1 of the Zoning Ordinance, including the impervious surface limitations. 7. The maximum driveway curb cut width shall be 24 feet. 8. The internal public street shall be permitted with a 50 -foot right of way and 28 - foot wide paved surface. One -streets shall be 16 feet wide. 9. On -street parking stalls shall be 9' x 23'. Resolution 2002-40 Page 2 10. The developer shall work with staff to revise the geometrics of the "Y" intersections and the one-way streets. 11. A trail shall be constructed on the north side of the street between the Centex project and the first cul de sac on the north. This trail shall be in addition to the trails shown on the applicant's plans. 12. The developer shall maintain an easement over the existing drive to the north for emergency access purposes. This easement must be maintained until the second phase of development is completed and the public the street is extended to Ehncrest Avenue. 13. The developer shall work with the City regarding park dedication requirements. Any park dedication fees in lieu of land dedication shall be provided pursuant to the Dedication Policy in effect at the time of recording the final plat. 14. The plans shall note the ordinary high water and 100 -year high water elevation for all water bodies. 15. The minimum floor elevation shall comply with Section 1175-060.1 of the Hugo Zoning Ordinance. 16. The developer is responsible for the full cost of the lift station construction. 17. The developer shall install a 12 -inch waterline. The City will reimburse the developer for the cost of increasing the waterline from 8- to 12 -inches. 18. The well and septic on Lot 5, Block 6 shall be abandoned and municipal utilities shall be extended to serve this property in the first phase of development. 19. The homeowners association shall be responsible for maintenance of Outlot B and the adjacent boulevard islands. 20. The developer must obtain all necessary permits from Rice Creek Watershed District.
