APPROVING A PRELIMINARY PLAT FOR LAKEVIEW HUGO LLP FOR
PROPERTY LOCATED EAST OF ELMCREST AVENUE, WEST OF FENWAY
BOULEVARD, NORTH OF 130TH STREET AND SOUTH OF 140M STREET
WHEREAS, Lakeview Hugo LLP has requested approval of a preliminary plat for
property legally described as follows:
The Northeast Quarter of the Southwest Quarter of Section 30, Township
31, Range 21, Washington County, Minnesota\
And
The Southeast Quarter of the Northwest Quarter of Section 30, Township
31, Range 21, Washington County, Minnesota
And
Outlot B, WOODS OF BALD EAGLE LAKE, according to the recorded
plat thereof, Washington County, Minnesota, EXCEPTING
THEREFROM that part of said Outlot B, platted as TOWNHOMES OF
BALD EAGLE LAKE, according to the recorded plat thereof, said
Washington County.
EXCEPT that part lying easterly of the following described line and its
southeasterly extension:
Commencing at the northwest comer of said Outlot B; thence south 89
degrees 00 minutes 36 seconds East, assumed bearing along north line of
said Outlot B, a distance of 255.07 feet to the point of beginning of the
line to be described; thence South 07 degrees 42 minutes 04 seconds West,
a distance of 556.10 feet; thence South 09 degrees 39 minutes 58 seconds
West, a distance of 213.94 feet; thence South 77 degrees 49 minutes 38
seconds East, a distance of 253.66 feet; thence South 55 degrees 55
minutes 49 seconds East, a distance of 358.46 feet; thence South 19
degrees 29 minutes 44 seconds West, a distance of 241.35 feet; thence
Southeasterly along a non-tangential curve concave to the southwest,
having a central angle of 36 degrees 22 minutes 35 seconds and a radius of
140.00 feet for an arc distance of 88.88 feet, the chord of said curve bears
South 52 degrees 18 minutes 59 seconds east; thence South 34 degrees 07
minutes 41 seconds East, tangent to said curve, a distance of 34.69 feet to
the north line of Lot 22, Block 7, said TOWNHOMES OF BALD EAGLE
LAKE and said line terminating.

That part of the Southwest Quarter of the Northwest Quarter of Section
30, Township 31 North, Range 21 West, Washington County, Minnesota,
described as follows:
Commencing at the southwest corner of said Southwest Quarter of the
Northwest Quarter thence North 0 degrees 36 minutes 23 seconds West,
assumed bearing along the west line of said Southwest Quarter of the
Northwest Quarter, 300.00 feet to the point of beginning of the parcel to
be described; thence South 89 degrees 32 minutes 20 seconds East, 1470
feet, more or less to the east line of said Southwest Quarter of the
Northwest Quarter, thence northerly along said east line, 312 feet, more or
less, to the north line of the South 604.68 West of said Southwest Quarter
of the Northwest Quarter, thence westerly along said north line, 1287 feet,
more or less, to the enter line of Elmcrest Avenue North; thence
southeasterly, along said center line, 366 feet, more or less to the point of
beginning.
Subject to Elmcrest Avenue North, This tract contains 10.00 acres, more
or less. Subject to and together with any other valid easements, restrictions
and reservations.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Lakeview Hugo LLP for a preliminary plat, subject to the following
conditions:
1. A preliminary plat is approved to allow the creation of 52 single family lots and three
outlots, in accordance with the plans and application received by the City on June 13,
2002 and revisions received on June 28, 2002 and July 2, 2002, except as amended by
this resolution.
2. Approval is contingent upon City Council approval of the rezoning from R-3 and R-1
to PUD.
3. Development standards shall be as approved as part of the PUD.
4. The developer shall review the numbering in the preliminary plat to eliminate
repetition of block numbers within the plat.
5. The right-of-way for public streets shall be 50 -feet wide.

6. The two-way streets shall be 28 feet wide face of curb to face of curb.
7. The developer shall work with staff to revise the geometrics of the "Y" intersections
and the one-way streets.
8. The on -street parking stalls shall be 9' x 23'.
9. The developer shall extend the eastern cul de sac north into to the City park. The
developer shall work with the City to design the street extension and the related
parking for the City park.
10. A trail shall be constructed on the north side of the street between the Centex project
and the first cul de sac on the north. This trail shall extend north on the cul de sac
into the City park. This trail shall be in addition to the trails shown on the applicant's
plans.
11. The plans shall note the ordinary high water and 100 -year high water elevation for all
water bodies.
12. The plans must identify normal water level, high water level and emergency overflow
for the ponds.
13. Utility plans and details must be submitted.
14. The developer shall work with the City regarding park dedication requirements. Any
park dedication fees in lieu of land dedication shall be provided pursuant to the
Dedication Policy in effect at the time of recording the final plat.
15. The developer must obtain all necessary permits from Rice Creek Watershed District.
16. The developer shall comply with all of the comments in the City water resource
engineer's memo dated July 16, 2002.
