APPROVING FINDINGS OF FACT DENYING THE CONDITIONAL USE
PERMIT AND PRELIMINARY PLAT FOR NORTH SUBURBAN
DEVELOPMENT FOR ONEKA LAKE VIEW SOUTH ON PROPERTY
LOCATED SOUTH OF ONEKA LAKE BOULEVARD BETWEEN GENEVA
AND GOODVIEW AVENUE
WHEREAS, North Suburban Development has requested approval of a conditional use
permit and preliminary plat to allow six twinhome units on property legally described as
follows:
Outlot B, Oneka Lake View
WHEREAS, the Planning Commission has reviewed the site plan at a duly called Public
Hearing and recommends denial, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does deny the
conditional use permit and preliminary plat for Oneka Lake View South, based on the
finding contained in the staff report dated July 5, 2002, including the following:
1. The common driveway would encroach into the drainage and utility easement
over the north 12 feet of the parcels. It is not possible to move the driveway 12
feet to the south to eliminate the encroachment because of the amount and
location of wetlands on each lot.
2. The proposed lots are inconsistent with the spirit and intent of the ordinance,
because over 90 percent of each lot is wetland. This condition provides no usable
yard space or other area for accessory residential uses.
3. The proposed twinhomes are incompatible with the adjacent single family homes
located on the south side of Oneka Lake Boulevard. While there are townhomes
on the north side of Oneka Lake Boulevard, staff finds that the presence of these
townhomes does not make the proposed twinhome units compatible with the
surrounding area. The City often uses public streets as transitions between
different intensities of land uses. In this particular case, Oneka Lake Boulevard
helps to provide the appropriate transition between the single family homes to the
south and the townhomes to the north. The construction of the proposed
twinhomes on the south side of Oneka Lake Boulevard would disrupt this orderly
transition.
4. The proposed development does not have adequate access. The applicant is
proposing a shared private driveway to serve the six units in lieu of a public
street. The 14 -foot wide driveway would create an unsafe situation for the future
residents, as well as motorists using Oneka Lake Boulevard.
5. The applicant has not submitted building plans demonstrating that the twinhomes
could be constructed in conformance with applicable City regulations.
