FOR PROPERTY LOCATED NORTH OF SWEET GRASS MEADOWS, WEST OF ONEKA LAKE AND EAST OF HIGHWAY 61 WHEREAS, Fegowi Development, Inc. has requested approval of a preliminary plat to allow 68 single family detached home lots and one outlot on property legally described as follows: That part of the north half of the southeast quarter of Section 17, Township 31 north, Range 21 west, Washington County, Minnesota, described as follows: Beginning at the east quarter corner of said Section 17, said corner is designated by a found Washington County cast iron monument, thence south 89 degrees 32 minutes 46 seconds west, along the north line of the southeast quarter of Section 17, a distance of 2095.85 feet to a point designated by a found % inch iron pipe, marked RL.S. 15835, thence south 00 degrees 12 minutes 54 seconds west 150.01 feet to a point designated by a found %s inch iron pipe, marked R.L.S. 15835, thence south 89 degrees 32 minutes 46 seconds west 137.95 feet to a point designated by a found % inch iron pipe, marked RLS. 13590, thence south 00 degrees 27 minutes 14 seconds east 166.10 feet to a point designated by a found % iron pipe, marked R.L.S. 9808; thence south 89 degrees 32 minutes 46 seconds west 0.20 feet; thence south 00 degrees 27 minutes 14 seconds east 254.10 feet to a point designated by a found % inch iron pipe, marked RL.S. 9808; thence south 89 degrees 32 minutes 46 seconds west 223.39 feet to a point designated by a set inch iron pipe, marked R.L.S. 13590, thence south 11 degrees 51 minutes 00 seconds west 128.17 feet to a point designated by a set % inch iron pipe, marked R.L.S. 13590; thence north 89 degrees 20 minutes 02 seconds east 440.34 feet to a point designated by a set % iron pipe, marked R.L.S. 13590, north 00 degrees 39 minutes 58 seconds west 58.47 feet to a point designated by a found % inch iron pipe, marked RLS. 13590; thence north 89 degrees 44 minutes 51 seconds east, 718.93 feet to the east line of the northwest quarter of the southeast quarter, Section 17, thence south 00 degrees 12 minutes 56 seconds west along said east line, 688.18 feet to southeast corner of the northwest quarter of the southeast quarter; thence north 89 degrees 44 minutes 51 seconds east, along said south line, 1320.06 feet to the southeast corner of said north half of the southeast quarter said point is designated by a found % iron pipe, marked R.L.S. 13590, thence north 00 degrees 12 minutes 31 seconds east, along the east line of said southeast quarter, 1330.72 feet to the point of beginning. WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the preliminary plat for Fegowi Development, Inc. for property to be known as "Oneka Ponds", subject to the following conditions: Resolution 2002-53 Page 2 1. A preliminary plat is approved to allow the creation of 68 single family detached home lots and one outlot in accordance with the application and plans received by the City on May 14, 2002, and revisions received June 18, 2002, July 15, 2002 and September 17, 2002, except as amended by this resolution. 2. Development standards shall be as required by the R-3 district. 3. No variances are approved or implied. 4. The developer shall provide the standard 32 -foot wide street width for all public streets within this development. The developer shall work with the City to provide an appropriate transition from the wider Goodview Avenue in Sweetgrass Meadows. 5. The developer shall provide the City with an easement for emergency vehicle access as shown on the plans. 6. The emergency vehicle access must be constructed and maintained to City standards. 7. The emergency vehicle access must be maintained until the Arcand property to the north is developed and a secondary access is provided. 8. The developer shall work with the City to coordinate construction with the City ditch project. 9. A drainage and utility easement shall be provided over ponds as required by the City water resources engineer. 10. The developer shall work with the City to identify locations for pond maintenance access easements. 11. The developer shall provide a pond outlet from Sweetgrass Meadows development. 12. The developer shall provide a storm sewer connection for a future outlet from Oneka Lake. 13. The developer shall use construction methods and materials such as extra insulation and triple -pane glass to mitigate noise impacts from the industrial property for the homes abutting Industrial Painting. 14. The developer shall include a disclosure statement about the adjacent Industrial Painting property and other nearby commercial/industrial property and the noise associated with these uses. The disclosure shall also be included in any sales information, covenants or homeowner association documents. 15. The developer shall provide landscaping in compliance with Section 1175-140.1, Subd. 15 of the Zoning Ordinance. M � 1 Resolution 2002-53 Page 3 16. The developer shall provide an irrigation system for the proposed landscaping on the berm. The irrigation system shall be maintained for a minimum of 10 years. Prior to final plat approval, the City must review and approve the developer's proposal to maintain the irrigation system. 17. The applicant must identify the location of the shoreland area on the plans. Lots 3-6, Block 1 would comply with ordinance requirements provided the homes are located outside of the shoreland area. 18. The developer shall comply with the minimum low floor elevations identified in City policy. 19. Utility plans and details must be submitted. 20. The developer shall work with the City to identify sidewalk and trail location, including along both main streets, connections to the Bernin property and a possible trail along the ditch. 21. The developer shall work with the City regarding park dedication requirements. Any park dedication shall be provided pursuant to the Dedication Policy in effect at the time of recording the final plat. 22. The developer must obtain all necessary permits from Rice Creek Watershed District. 23. The developer shall comply with all of the comments in the City engineer's memo dated September 19, 2002. 24. Grading, drainage and utility plans are subject to final review and approval by the City Engineer. 25. The applicant shall provide landscape screening along the west side of the plat adjacent to the ditch. A landscape plan with the additional screening shall be provided prior to approval of the final plat. ADOPTED by the City Council this 7th day of Octo 002.
