APPROVING A PRELIMINARY PLAT FOR MICHAEL MASSIE FOR
PROPERTY LOCATED NORTH OF 125D STREET
WHEREAS, Michael Massie has requested approval of a preliminary plat for property
legally described as follows:
The southwest quarter of the northeast quarter of Section 33, Township 31, Range
21; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
request by Michael Massie for a preliminary plat, subject to the following conditions:
1. A preliminary plat is approved to allow the creation of four rural residential lots, in
accordance with the plans and. application received by the City on September 16,
2002.
2. The development is subject to the general development standards of the Rural
Residential zoning district.
3. The plat shall include 33 feet of right-of-way over the northerly half of 125th Street.
4. The developer must obtain all necessary permits from Rice Creek Watershed District.
5. Prior to recording the final plat, the developer shall pay the park dedication fees in
lieu of land dedication, pursuant to the Dedication Policy in effect at the time of
recording the final plat. The .park dedication fee is currently $1,700.00 per lot.
6. The City shall review the placement of driveways at the time of building permit to
ensure that they have adequate sight visibility.
7. The applicant shall disclose, to future buyers, the location of the Bald Eagle
Sportsman Club located south of 125& Street. The disclosure statement shall note
that gun noise may be audible from the property.
ADOPTED by the City Council this 21 st day of October 2002.
