APPROVING FINDINGS OF FACT FOR REZONING FOR TRAIL HEAD LAND
DEVELOPMENT, LLC AND PULTE HOMES OF MINNESOTA FOR "WATERS
EDGE NORTH" ON PROPERTY LOCATED EAST OF EVERTON AVENUE
NORTH IN THE NORTHEAST QUADRANT OF SECTION 18, T3 IN, R21 W
WHEREAS, Trail Head Land Development, LLC and Pulte Homes of Minnesota have
requested reclassification of the zoning from Future Urban Reserve to PUD (planned unit
development) for a 186 -acre parcel, legally described as follows:

NE 1/4 of Section 18, Township 31, Range 21, Washington County,
Minnesota.

County, Minnesota;
EXCEPT
That part of the Northwest Quarter of the Southeast Quarter (NW 1/4 of
SE 1/4) of Section Eighteen (18), Township Thirty-one (3 1) North, Range
Twenty-one (21) West, Washington County, Minnesota, described as
follows: Commencing at the South Quarter corner of Section 18; thence
Northerly along the North-South Quarter line of Section 18 a distance of
1521 feet to the point of beginning; thence Easterly at right angles, a
distance of 436 feet; thence Southerly at right angles, a distance of 200
feet, more or less, to the South line of NW 1/4 - SE 1/4 of Section 18;
thence Westerly along the South line of NW 1/4 - SE 1/4 of Section 18, a
distance of 436 feet, more or less, to the Southwest corner of NW 1/4 - SE
1/4 of Section 18; thence Northerly, along the North-South Quarter line of
Section 18, a distance of 200 feet more or less to the point of beginning,
containing two acres more or less, and subject to the existing township
road along the West line thereof, Washington County, Minnesota.

Abstract
WHEREAS, the Planning Commission has reviewed the request at a duly called Public
Hearing and recommends approval, and;
WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from
Future Urban Reserve to PUD;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does support the request
by Trail Head Land Development, LLC and Pulte Homes of Minnesota for the
reclassification of the zoning from Future Urban Reserve to PUD for the 186 -acre
property, based on the following findings:
1. The proposed rezoning is consistent with the Comprehensive Plan and other City
policies and plans. The development would allow a mix of single-family detached
homes, patio homes and townhomes at a net density of 3.7 units per acre, which is
consistent with the Comprehensive Plan and Zoning Ordinance requirements.
2. The proposed development meets the intent of the PUD zoning district by providing
an efficient use of land by using smaller lots to preserve wetlands and open space,
preservation of the wildlife/open space corridor in the northwest portion of the site,
providing a 0.5 mile long greenway with trail along the eastern property line, and
providing 2.84 times the required amount of park dedication, including 22.30 acres of
land dedication for a school community playfield site.
3. The PUD will allow a more creative and efficient approach to land use within the
City, while at the same time protecting and promoting the health, safety, comfort,
aesthetics, economic viability and general welfare of the City.
4. The proposed development meets the intent of the PUD zoning district by creating an
integrated neighborhood, lifecycle housing opportunities, preservation of natural

resources and dedication of park land (including a school/community playfield site)
that would not otherwise be possible through a strict interpretation of the Zoning
Ordinance.
5. The density transfer allowed by the PUD would allow the developer to provide single
family homes on smaller lots in the eastern portion of the site to provide a transition
from the Creekview Preserve development to higher density on the south and western
portions of the site. The PUD would provide appropriate transitions between
differing land uses within the site and adjacent land uses.
6. The development would incorporate common design elements. The buildings would
have common design elements and similar landscape materials would be used
throughout the development.
7. The development would provide a higher level of design in the PUD by providing a
landscaped parkway, decorative street lighting, nearly three times the required
amount of park dedication and trails or- sidewalks on all public streets.
8. There is adequate infrastructure to support the proposed rezoning and development.
The development will extend utilities to the south property line to allow future
development of that property and the ultimate extension of the parkway to CSAH 8.
9. The PUD will improve the efficiency of public streets and utilities by providing a
needed north -south corridor with construction of the parkway and extension of 159'
Street as an east -west collector road.
