APPROVING CONDITIONAL USE PERMIT FOR WHITE BEAR LAKE AREA
SCHOOLS FOR TEMPORARY CLASSROOM BUILDINGS ON PROPERTY
LOCATED AT 14895 FRANCESCA AVENUE NORTH
WHEREAS, White Bear Lake Area Schools has requested approval of a conditional use
permit for temporary classroom buildings on property legally described as follows:

WHEREAS, the Planning Commission has reviewed said conditional use permit at a duly
called public hearing and recommends approval of the conditional use permit, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
conditional use permit for White Bear Lake Area Schools on property located at 14895
Francesca Avenue North. The conditional use permit shall be subject to the following
conditions:
1. A conditional use permit is approved for six temporary classroom buildings and one
temporary support building (restrooms, storage, etc.) as indicated on the application
and site plan received by the City on December 13, 2000.
2. The temporary classroom buildings shall be removed from the property if the school
is vacated or by July 1, 2005, unless an extension is granted by the City Council.
Prior to the City Council considering an extension, the Planning Commission shall
review the application and provide a recommendation to the City Council
3. The applicant shall provide emergency vehicle access to the temporary classroom
buildings as required by the fire code and the City's Fire Chief. The access drive
shall be 20 feet wide and have a 7 -ton design.
4. The applicant shall obtain all necessary state and local permits, and said permits are
not abrogated by the issuance of the conditional use permit.
5. The conditional use permit is approved based on the finding that the temporary
classroom buildings comply with the standards provided in Section 8.8 c. of the
Resolution 2001-2

Comprehensive Land Use regulations. More specifically, the City Council finds the
following:
a) The proposed use is permissible by law. Schools are allowed in residential zoning
districts subject to the approval of a conditional use permit.
b) The proposed use is keeping with the spirit and intent of the ordinance. The proposed
school use is consistent with the residential zoning of the property.
c) The proposed use is compatible with the City's Comprehensive Plan, and the
character of the surrounding area. The existing school and temporary classroom
buildings are consistent with the Urban Development classification in the
Comprehensive plan. Further, the temporary classroom buildings would be consistent
with the surrounding area. (The applicant will present elevations or pictures of the
proposed building at the public hearing.)
d) The proposed use has adequate drainage, water supply, electrical, gas, and sewage
treatment facilities. The school site has adequate utilities to serve the temporary
classroom buildings.
e) The proposed use has adequate road access. The subject property receives direct
access from Francesca. The conditional use permit standards require school sites to
have their principal entrance from a state highway, county highway, or collector road.
While the site does not have direct access to a collector road or county highway, the
site is within close proximity of Oneka Lake Boulevard (collector road) and Highway
61. Further, the site currently contains a school building, and the six temporary
classroom buildings would not significantly increase traffic.
If the school district wishes to add a permanent addition in the future, the City would
need to examine potential traffic impacts associated with the expansion.
f) Technical Evaluation of Floodplain. The school site is not located within a
floodplain.
g) The proposed use should not increase the potential for flood damage. The proposed
use would not increase the potential for flood damage.
h) The proposed use will not damage or reduce the benefits the public receives from
public waters. The proposed temporary classroom buildings would not damage or
reduce the benefits from any public waters.
i) The use of watercraft on public waters. The proposed buildings would not involve
the use of watercraft.

j) All structures shall be screened from view of public waters. The school buildings
would not be visible from public waters.
k) Wetland impacts. The proposed use would not impact any wetlands.
1) All state and local permits shall be acquired for the conditional use. The applicant
will be responsible for obtaining all state and local permits.
m) Adequate screening and buffering from non -compatible uses and public rights-of-
way. School buildings are generally considered to be compatible with residential
uses. In fact, most schools are located within residential areas, as opposed to
commercial or industrial properties.
