RESOLUTION 2001 - 23
APPROVING FINDINGS OF FACT DENYING A ZONING ORDINANCE TEXT
AMENDMENT APPLICATION REGARDING CLUSTER HOUSING SUBMITTED BY
SEDONA HOMES
WHEREAS, Sedona Homes initiated a zoning ordinance text amendment to modify the
provisions of the City's Comprehensive Land Use Regulations regarding cluster housing; and,
WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends denial.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HUGO, MINNESOTA, that it should and hereby does deny the requested zoning
ordinance text amendment regarding cluster housing, as submitted by Sedona Homes, based on
the following findings:
1. The City adopted a new comprehensive zoning ordinance in 1999. The applicant has not
demonstrated that the current ordinance provisions are inappropriate and that the
proposed text amendment has merit beyond the interests of the proponent
2. The applicant has not demonstrated that the proposed zoning ordinance text amendment
is necessary to enjoy a reasonable use of property. The current cluster housing
standards and general zoning ordinance provisions allow for the reasonable and viable
economic use of property within the City.
3. The City Council finds that some changes to the cluster housing provisions may be
appropriate, but that additional time is needed to complete an in-depth study of cluster
housing as it relates to the City's Comprehensive Plan and other City policies.
4. The City Council would like to gather additional information and solicit additional
public input prior to considering changes to the City's cluster housing standards.
