WHEREAS, Niki Bramstedt has requested that the City approve a setback variance to allow the construction of a mound system drain field 50 feet from a wetland where 75 feet is required: Insert Legal WHEREAS, the City Council has reviewed said request and finds that the proposed mound system would not negatively impact the public health and safety, and; WHEREAS, the Washington County Department of Public Health and Environment has reviewed said request and has no objections to the requested variance. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve a variance to permit construction of a mound system drain field at 50 feet from a wetland where 75 feet is required on property located east of Goodview and north of Egg Lake Road. CITY OF HUGO RESOLUTION 2001- 36(A) APPROVING PRELIMINARY PLAT FOR SEDONA HOMES FOR PINEVIEW MEADOWS 2ND ADDITION ON PROPERTY LOCATED SOUTH OF EGG LAKE ROAD AND EAST OF HIGHWAY 61 WHEREAS, Sedona Homes has requested approval of a preliminary plat to allow construction of 66 townhome lots on property legally described as follows: Insert Legal Description WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the preliminary plat for Sedona Homes on property located south of Egg Lake Road and East of Highway 61, subject to the following conditions: 1. A preliminary plat is approved to allow the creation of 66 townhome lots, in accordance with the plans and application received by the City on June 6, 2001, except as amended by this resolution. 2. The applicant shall demonstrate that adequate water pressure and flows are available to serve the development at the time of final plat. If needed to provide adequate pressure or flows, the applicant shall loop the water main to the existing water main along Highway 61. 3. The water main in the east/west street shall be increased from a six-inch pipe to an eight -inch pipe to allow for the looping of the water main. 4. Sidewalks shall be required along one side of the public street. Sidewalk easements may be required at the time of final plat if additional area is needed to accommodate the sidewalks and utility installation. 5. The applicant shall pay park dedication fees prior to recording of the final plat. 6. The applicant shall obtain approval of the land development plan by the Rice Creek Watershed District. i Resolution 2001- 36A Page 2 7. A temporary cul-de-sac or other approved turnaround shall be provided at the end of Flay Avenue. 8. The applicant shall provide a connection to the private driveway easement located west of the property to provide a secondary means of access for public safety vehicles. A breakaway gate shall be installed at the end of the east/west road to prevent residents from using this access drive. 9. The public roadways shall be 32 feet measured face to face of the curb. 10. The applicant shall revise the storm water drainage plan as required by the City's Water Resources Engineer. ADOPTED by the City Council this 17th day of July 2001.
