RESOLUTION 2001- 55
APPROVING FINDINGS OF FACT DENYING A COMPREHENSIVE PLAN
AMENDMENT FOR GOR -EM LLC. FOR PROPERTY EAST OF GOODVIEW AVENUE
AND SOUTH OF 145TH STREET
WHEREAS, Gor-Em LLC requested a Comprehensive Plan Amendment to include
approximately 59 acres of land in the MUSA; and,
WHEREAS, the subject property is located west of Goodview and south of 145th Street, legally
described as follows:
The SW 1/4 of Section 21 T31N-R21W.
WHEREAS, the Planning Commission has reviewed said request at a duly called Public Hearing
and recommends denial; and
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, MINNESOTA, that it should and hereby does deny the request of Gor-Em LLC. to
include approximately 59 acres within the MUSA for land located east of Goodview Avenue and
south of 145th Street, based on the following findings:
1. The proposed request is inconsistent with the Comprehensive Plan with regard to the
future extension and staging of urban services. Currently, the property is scheduled to be
serviced with municipal sewer and water after the year 2020.
2. The requested Comprehensive Plan Amendment is not needed to enjoy a reasonable use
of the property, because the property can currently be used for agricultural pursuits or
large lot residential on private well and septic.
3. The applicant did not demonstrate or provide adequate reasons as to why the City should
consider amending its Comprehensive Plan to include the property in the MUSA.
4. Including the subject property in the MUSA would negatively impact many of the
adjacent roads. Further, the intersection of 147th Street and Highway 61, which would
serve as the primary route out of this development, is substandard and operating at or
above capacity during peak hours. The City currently has no plans to improve the
intersection of 147th Street and Highway 61.
ADOPTED by the City Council on September 17, 2001.
