HomeMy WebLinkAbout2001.10.15 RESO 2001-0059CITY OF HUGO RESOLUTION 2001- 59 APPROVING A PUD PLAN AND PRELIMINARY PLAT FOR SOLID GROUND DEVELOPMENT FOR HIDDEN HILLS PRESERVE ON PROPERTY LOCATED EAST OF GOODVIEW, SOUTH OF 130' STREET, AND NORTH OF 125rH STREET WHEREAS, Solid Ground Development has requested approval of a PUD and preliminary plat to allow a cluster housing development consisting of 12 single family lots on property legally described as follows: (see attached) WHEREAS, the Planning Commission has reviewed the PUD and preliminary plat at a duly called Public Hearing and recommends approval, and; NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the PUD and preliminary plat for Solid Ground Development for property located east of Goodview, south of 130` Street, and north of 125" Street, subject to the following conditions: 1. A PUD and preliminary plat is approved to allow the creation of 12 single family lots, in accordance with the plans and application received by the City on September 4, 2001, except as amended by this resolution. 2. The applicant shall revise the plat to provide the correct lot dimensions for Lot 5, Block 2 prior to submittal of a final plat. 3. The applicant shall provide an emergency vehicle access as shown on the preliminary plat. The emergency access shall comply with the following standards: a) A gate shall be installed at the end of the private drive to prevent general traffic from using the emergency vehicle access; b)The drive on the subject property shall consist of a seven -on design; c) "No parking fire lane" signs shall be installed adjacent to the drive; d) The City's Fire Chief shall approve the type of gate and signage prior to installation; e) The emergency vehicle access shall extend from the end of the cul-de- sac to Goodview Avenue; and f) The homeowners association shall be responsible for general maintenance of the emergency access, including keeping it clear of snow in the winter time. 4. The applicant shall provide a 33 -foot public roadway easement along the northerly boundary of the plat. Additionally, the applicant shall provide additional roadway easements in the northeast and northwest comer of the plats to allow for future Resolution 2001-59 Page 2 roadway extensions. These easements shall be provided to the City Engineer for review prior to recording. 5. The applicant shall provide a public roadway easement over the emergency vehicle access located on the subject property. 6. The applicant shall provide the City with a copy of the emergency vehicle access easement over the adjacent property. 7. The public street shall be a minimum of 32 feet measured shoulder to shoulder for the first 1,600 feet. The remainder of the street shall be 28 feet measured shoulder to shoulder. The cul-de-sacs shall have a minimum radius of 50 feet. 8. A survey of each lot shall be submitted with all building permits for new homes. The survey, in addition to the information required by City ordinances, shall include 1) existing and proposed contours/elevations, 2) significant trees over 12 inches in diameter, and 3) proposed ground cover and/or natural area preservation. 9. The applicant shall require at least two tree (minimum diameter of 2.5 inches) in the front yard of each home site. 10. The applicant shall attempt to minimize the removal of all significant trees. A significant tree is defined as a tree that is 12 inches or larger in diameter. Significant tree removal for a home, driveway, and septic systems shall be permitted if the homeowner can demonstrate that no other feasible option exists. Further, significant tree removal shall be permitted for the proposed road and drainage improvements as shown on the preliminary plat. 11. The applicant shall provide a conservation easement over the common open space areas. 12. The applicant shall provide the City with a copy of the homeowners association documents prior to recording the final plat. The homeowners documents, at a minimum, shall address the following: 1) maintenance of the emergency vehicle access, 2) the common open space areas, 3) the proposed trail, 4) restrictions on tree removal and landscaping, and 5) the need to submit a grading plan and tree preservation and landscaping plan with each home site. 13. Storm water fees in the amount of $13,068 shall be paid prior to the recording of the final plat. 14. Park dedication fees in the amount of $16,200 shall be paid prior to the recording of the final plat. Resolution 2001-59 Page 3 15. Improved trails shall be prohibited on the property. The applicant shall revise the site plan by eliminating the proposed trail. 16. The applicant shall provide drainage calculations for the storm water improvements prior to the submittal of the final plat. 17. The applicant shall obtain the necessary permits from the Rice Creek Watershed District. 18. The applicant shall disclose, to future buyers, the location of the Bald Eagle Sportsman Club located south of 125th Street. The disclosure statement shall note that gun noise may be audible from the property. ADOPTED by the City Council this 15th day of October 2001.
