RESOLUTION 2001- 74
APPROVING A FINAL PLAT AND DEVELOPMENT AGREEMENT FOR
SOLID GROUND DEVELOPMENT FOR HIDDEN HILLS PRESERVE ON
PROPERTY LOCATED EAST OF GOODVIEW, SOUTH OF 130TH STREET,
AND NORTH OF 125m STREET
WHEREAS, Solid Ground Development has requested approval of a final plat for 12
single family lots on property legally described as follows:
(see attached)
WHEREAS, the Planning Commission has reviewed the preliminary plat at a duly called
Public Hearing and recommends approval, and;
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the final
plat and development agreement for Solid Ground Development for property located east
of Goodview, south of 130"' Street, and north of 125"' Street, subject to the following
conditions:
1. A final plat is approved to allow the creation of 12 single family lots, in accordance
with the plans and application received by the City on November 19, 2001, except as
amended by this resolution.
2. The applicant shall provide an emergency vehicle access as shown on the preliminary
plat. The emergency access shall comply with the following standards: a) A gate
shall be installed at the end of the private drive to prevent general traffic from using
the emergency vehicle access; b) The drive on the subject property shall consist of a
seven -ton design; c) "No parking fire lane" signs shall be installed adjacent to the
drive; d) The City's Fire Chief shall approve the type of gate and signage prior to
installation; e) The emergency vehicle access shall extend from the end of the cul-de-
sac to Goodview Avenue; and i) The homeowners association shall be responsible for
general maintenance of the emergency access, including keeping it clear of snow in
the winter time.
3. The applicant shall provide the City with a copy of the emergency vehicle access
easement over the adjacent property prior to recording the final plat.
4. The public street shall be a minimum of 32 feet measured shoulder to shoulder for the
first 1,600 feet. The remainder of the street shall be 28 feet measured shoulder to
shoulder. The cul-de-sacs shall have a minimum radius of 50 feet.

5. A survey of each lot shall be submitted with all building permits for new homes. The
survey, in addition to the information required by City ordinances, shall include 1)
existing and proposed contours/elevations, 2) significant trees over 12 inches in
diameter, and 3) proposed ground cover and/or natural area preservation.
6. The applicant shall require at least two tree (minimum diameter of 2.5 inches) in the
front yard of each home site.
7. The applicant shall attempt to minimize the removal of all significant trees. A
significant tree is defined as a tree that is 12 inches or larger in diameter. Significant
tree removal for a home, driveway, septic systems, and related improvements shall be
permitted if the homeowner can demonstrate that no other feasible option exists.
Further, significant tree removal shall be permitted for the proposed road and
drainage improvements as shown on the preliminary plat.
8. The applicant shall provide a conservation easement over the common open space
areas. The conservation easement shall be reviewed and approved by the City
Attorney prior to recording.
9. The applicant shall provide the City with a copy of the homeowners association
documents prior to recording the final plat. The homeowners documents, at a
minimum, shall address the following: 1) maintenance of the emergency vehicle
access, 2) the common open space areas, 3) restrictions on tree removal and
landscaping, and 4) the need to submit a grading plan and tree preservation and
landscaping plan with each home site.
10. Storm water fees in the amount of $13,068 shall be paid at the time the final plat is
recorded.
11. Park dedication fees in the amount of $16,200 shall be paid at the time the final plat is
recorded.
12. The applicant shall disclose, to future buyers, the location of the Bald Eagle
Sportsman Club located south of 125x` Street. The disclosure statement shall note
that gun noise may be audible from the property.
13. The building setback from the south property line on lots 6 and 7 shall be a minimum
of 120 feet.
14. The centerline radius of 130x` Street shall be a minimum of 300 feet.
15. The construction plans are approved subject to final review and approval by the City
Engineer.
