HomeMy WebLinkAbout2000.04.03 RESO 2000-0008RESOLUTION 2000 - 8 A RESOLUTION ESTABLISHING A PROGRAM TO PURCHASE HOMES IN THE CITY'S CENTRAL BUSINESS DISTRICT WHEREAS, The City of Hugo has prepared a redevelopment strategy for Downtown Hugo, dated November, 1998, which proposes to replace residential uses along portions of Forest Boulevard and 14e Street with new commercial development; and WHEREAS, the City has in the adoption of its Comprehensive Land Use Plan and revised zoning ordinance designated this area as the City's Central Business District; and WHEREAS, the City of Hugo established Development District No. 1, on August 19, 1996, to facilitate development activities in the community, to remove physical and economic barriers to development, provide infrastructure improvements, and create sites for development; and WHEREAS, the City of Hugo has prepared a Transportation Planning Study, dated September 1999, which predicts that both Forest Boulevard (T.H. 61) and 14e Street (CSAH 8) will require expansion to four lanes to serve the increasing traffic demands of the community; and WHEREAS, the City of Hugo has agreed to jointly prepare a CSAH 8 corridor realignment study with Washington County to determine in what manner and location this highway should be improved; and WHEREAS, the City's Master Park Plan proposes the establishment of a community park at the intersection of 145"' Street and Forest Boulevard to enhance the commercial area; and WHEREAS, it will be necessary for the City to purchase property in the Central Business District for road expansion and commercial redevelopment; and WHEREAS, it is to the City's benefit to acquire these properties without the use of its powers of eminent domain where possible, thus avoiding high legal and relocation costs; and WHEREAS, property owners in the Central Business District have, and are expected to continue placing, their properties on the open market for sale; and WHEREAS, Minnesota Statutes Chapters, 412.211, 465.28, and 469.012, 469.137 and 471.191, and other applicable laws, grant the City authority to acquire property for public purposes, including, but not limited to, construction of streets and public utilities, parks and recreation purposes, and economic development and redevelopment; and NOW, THEREFORE, be it resolved by the Council of the City of Hugo, Washington County, Minnesota, that the following program to purchase residential properties in the City's Central Business District is established to promote and encourage the redevelopment of the District. 1.0 Purpose and Intent. The program is established to acquire selected residential properties in the City's Central Business District in preparation for road improvement and commercial redevelopment projects, on a willing -seller basis. 2.0 Authority. This policy is adopted pursuant to the authority granted the City of Hugo by law, including, but not limited to, Minnesota Statutes Chapters 412.211, 465.28, and 469.012 (5), 469.137 and 471.191. 3.0 Property Eligible for Acquisition. All residential properties, including single-family homes and multi -family apartments, located in the Central Business Zoning District, and abutting either 14e Street or Forest Boulevard, are eligible for purchase under this program. 4.0 Method of Acquisition. 4.1 Property shall become eligible for purchase by the City when it is offered for sale by the owner, either through a direct offer to sell the property by the owner, the listing of the property for sale through a realty agent, or other free-will offer to sell made by the owner. 4.2 Upon an offering to sell an eligible property, the City Administrator shall cause a fair market appraisal to be made of the property by a Certified General Appraiser knowledgeable of the areas realty market and otherwise qualified to perform such services in the State of Minnesota. 4.3 When completed, such appraisal shall be presented to the Council for review and approval. Following approval of the appraisal, and subject to the availability of adequate funds, the City Administrator shall tender an offer to purchase the property to the owner, or the owner's agent, in the amount of the approved appraisal, or a lower amount, in the best interests of the City. 4.4 If the owner agrees to sell the property to the City at the price offered, a Purchase Agreement shall be prepared by the City Attorney and executed on behalf of the City, by the Mayor. 4.5 The City shall not be bound to purchase, and does not guarantee to purchase any property under this program. 5.0 Distribution of Closing Costs and Realtor's Fees. 5.1 The buyer and seller shall pay for closing costs and fees under the standard conditions used in residential property transactions. 5.2 The seller shall pay all realtor fees, if any. 5.3 The City shall not pay for any personal property, moving expenses, attorney's fees, transportation or temporary lodging expenses, renovation or other costs that may be incurred by the seller as part of the transaction. 6.0 Property Management. The City of Hugo may enter into an agreement with a property management company to lease out houses obtained through this program until the properties are required for redevelopment. 7.0 Funding. 7.1 A Central Business District (CBD) Property Acquisition fund is hereby established to provide funding for property acquisitions made under this policy. 7.1.1 The City Council may, from time to time, allocate monies to the CBD Property Acquisition Fund for the purpose of carrying out this policy. 7.1.2 The City shall not make an offer to purchase any property under this policy until, and unless, adequate monies are available to pay for the purchase. 7.1.2 The City shall not make an offer to purchase any property under this policy until, and unless, adequate monies are available to pay for the purchase. 7.2 A CBD operations fund is hereby established to account for all monies used in the administration and operation of this program. 7.2.1 All property lease payments paid on properties purchased under this program, and other revenues received in the conduct of this program, shall be deposited to the credit of this fund. 7.2.2 All expenses associated with the program, including property appraisals, attorneys' fees, etc., shall be billed against this account. 7.2.3 The City's Finance Director shall annually make a transfer from the City's general fund to the CBD account to cover any shortfall between the fund's revenues and expenses.
