RESOLUTION 2000- 16 <br />CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION VACATING A 10 FEET WIDE DRAINAGE AND UTILITY EASEMENT <br />WITHIN THE PLAT OF WOODS OF BALD EAGLE LAKE. <br />WHEREAS, the City of Hugo has been petitioned by the Developers of the major <br />subdivision of Townhomes of Bald Eagle to vacate a ten (10) feet wide drainage and utility <br />easement which had been dedicated over part of Outlot B of the plat of Woods of Bald Eagle Lake. <br />The applicants' petition provides that the old drainage and utility easements would be vacated, and <br />that new, more accurately calculated drainage and utility easements would be dedicated to the City <br />at the time of final plat approval of the new plat of Townhomes of Bald Eagle; and, <br />WHEREAS, the new proposed plat of Townhomes of Bald Eagle exists within <br />Outlot B of the plat of Woods of Bald Eagle Lake; and, <br />WHERAS, it appears to the City Council that the public interest would be served by <br />vacating the old drainage and utility easements and receiving new ones; and, <br />WHEREAS, it appears for the foregoing reasons to be in the public interest to vacate <br />the easements described herein. <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE <br />CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA AS FOLLOWS: <br />hereby vacated: <br />1. That the drainage and utility easements described below be and the same are <br />That 10 foot wide drainage and utility easement dedicated over that part of <br />Outlot B, Woods of Bald Eagle Lake, Washington County, Minnesota, lying <br />adjacent to 130' Street North, as dedicated on said plat. <br />2. That this vacation shall have no force or effect until the final plat of <br />Townhomes of Bald Eagle is approved by the City Council of the City of Hugo and recorded at the <br />Washington County Recorder's Office. <br />3. That the City Administrator shall prepare a Notice of Completion of these <br />proceedings, which shall contain the name of the City, the identification of the vacation, a statement <br />of the time of completion thereof, and a description of real estate and land affected thereby. Such <br />notice shall be presented to the County Auditor/Treasurer who shall enter the same in his/her <br />transfer records and note upon the instrument over his/her official signature the words, "Entered in <br />the transfer records." The Notice shall then be filed with the County Recorder, all as required <br />pursuant to Minnesota Statutes Section 412.851. <br />
