CITY OF HUGO
WASHINGTON COUNTY, M NNESOTA
A RESOLUTION VACATING PORTIONS OF 130TH STREET NORTH AND EUROPA TRAIL
NORTH WITHIN THE PLAT OF WOODS OF BALD EAGLE LAKE.
WHEREAS, the City of Hugo has been petitioned by the Developers of the major
subdivision of Townhomes of Bald Eagle to vacate portions of 13e Street North and Europa Trail
North located within Outlot B of the plat of Woods of Bald Eagle Lake; and,
WHEREAS, the new proposed plat of Townhomes of Bald Eagle exists within
Outlot B of the plat of Woods'of Bald Eagle Lake; and,
WHEREAS, the Applicants' petition provides that the road areas being vacated
herein would be rededicated to the City at the time of final plat approval of the proposed plat of
Townhomes of Bald Eagle; and,
WHERAS, it apears to the City Council that the public interest would be served by
vacating those portions of 130 Street North and Europa Trail North existing within Outlot B of
Woods of Bald Eagle Lake; and,
WHEREAS, it appears for the foregoing reasons to be in the public interest to vacate
the roadways described herein.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF HUGO, WASHINGTON COUNTY, MNNESOTA AS FOLLOWS:
1. That all of 130'h Street North and Europa Trail North, as previously
dedicated on the plat of Woods of Bald Eagle Lake described as lying northerly of a line described
as beginning at the northeast corner of Lot 12, Block 3, said Woods of Bald Eagle Lake; thence
easterly to the northwest corner of Lot 15, Block 5, said Woods of Bald Eagle Lake and said line
there terminating, are hereby vacated.
2. That this vacation shall have no force or effect until the final plat of
Townhomes of Bald Eagle is approved by the City Council of the City of Hugo and recorded at the
Washington County Recorder's Office.
3. That the City Administrator shall prepare a Notice of Completion of these
proceedings, which shall contain the name of the City, the identification of the vacation, a statement
of the time of completion thereof, and a description of real estate and land affected thereby. Such
notice shall be presented to the County Auditor/Treasurer who shall enter the same in his/her
transfer records and note upon the instrument over his/her official signature the words, `Entered in
the transfer records." The Notice shall then be filed with the County Recorder, all as required
pursuant to Minnesota Statutes Section 412.851.
WHEREUPON, a vote being taken upon the motion, the following members voted
in favor. Debra Barnes, Jim Leroux, Becky Petryk, Walter Stoltzman
The following voted against: NONE
WHEREUPON, said motion was declared duly passed and adopted by the City
Council this 19th day. of June, 2000.
