RESOLUTION 2000 - 25
APPROVING A CONDITIONAL USE PERMIT FOR KIEGER ENTERPRISES, INC.
FOR AN ENVIRONMENTAL CLEAN-UP BUSINESS, INCLUDING VEHICLE
REPAIR FACILITIES, COLD STORAGE, EXTERIOR STORAGE OF VEHICLES
AND EQUIPMENT, AND COMPANY OFFICES FOR PROPERTY LOCATED AT
5885 -165TH STREET NORTH
WHEREAS, Kieger Enterprises, Inc. has requested approval of a conditional use permit
for an environmental clean-up business, including vehicle repair facilities, cold storage,
exterior storage of vehicles and equipment, and company offices on property legally
described as follows:
That part of the southeast quarter of the Section 8, Township 31 North, Range 21
West, Washington county, Minnesota
WHEREAS, the Planning Commission has reviewed said request at a duly called public
meeting and recommends approval of the Conditional Use Permit.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the
conditional use permit for Kieger Enterprises on property located at 5885-165' Street
North subject to the following conditions:
1. The use must not have sewage disposal needs which exceed three residential
equivalencies as determined by Metropolitan Council Environmental Services
standards.
2. The property must meet the Dimensional Requirements for Standard
Development outlined in Figure 3-2 of the City's Comprehensive Land Use
Regulations.
3. No land use may produce obnoxious or continuous smoke, as measured at the
point of emission, by any means. All emissions shall comply with Minnesota
Rules, Chapter 7011.

4. All landscaping indicated on the Site Plan dated February 14, 2000 (revised June
15, 2000) must be maintained in accordance with the requirements of Section 5.18
of the City's Comprehensive Land Use Regulations.

reference to the following:

6. Review and renewal of the CUP after an initial two year period, with a 4 -year review
and renewal period thereafter.
7. The applicant shall pave a 165' Street North extending east from the driveway to the
existing paved surface, which is a distance of approximately 250 feet. Additionally,
the applicant shall pave that portion of 165' Street North extending west a distance of
50 feet in order to provide a transition between the gravel and paved surfaces. The
applicant shall submit construction plans, prepared by a professional engineer, to the
City Engineer for review and approval. The paved road surface shall meet the City
standards for a nine ton street section. The applicant shall submit the construction
plans to the City no later than November 30, 2000, and shall complete the paving no
later than June 30, 2001.
8. Access to the site shall be limited to 165th Street North. The access to Highway 61
shall be used only for and by public safety vehicles.
9. The applicant shall maintain the emergency vehicle access and circulation route as
indicated on the plans received by the City on August 1, 2000.
10. All hazardous waste and non -recyclable waste products produced by the applicant's
business and other operations on the site shall be disposed of in accordance with
applicable local, County, State, and Federal laws. The applicant shall obtain the
necessary permits from Washington County for the storage of any hazardous waste
material.
11. The number of buildings, amount of outside storage, and uses identified on the site
plan dated February 14, 2000 and the application dated April 15, 2000 shall not be
enlarged or expanded, unless a new conditional use permit is applied for and
approved.

12. There shall be no outside storage of any junk or inoperable equipment or vehicles.
13. The normal hours of operation shall be limited to 6:30 a.m. to 9:00 p.m., Monday
through Saturday for all maintenance and operation of equipment on the site
(excluding the moving of vehicles on and off the site), unless it is for the purpose of
mobilizing equipment in response to an emergency, or for street cleaning or snow
plowing operations.
