RESOLUTION 2000 - 26
APPROVING AN ENCROACHMENT AGREEMENT FOR JACK WUSSLER TO
CONSTRUCT A RETAINING WALL WITHIN A DRAINAGE AND UTILITY
EASEMENT ON PROPERTY LOCATED AT 12646 ETHAN AVENUE.
WHEREAS, Mr. Jack Wussler has requested that the City approve an encroachment
agreement to allow the construction of a retaining wall within a drainage and utility
easement for property legally described as follows:
Lot 6, Block 1, Oakshore Park
WHEREAS, the City owns an easement for drainage purposes along the southerly lot line
of Lot 6, Block 1, Oakshore Park, and;
WHEREAS, the retaining wall is necessary for the purpose of backfilling around the
existing foundation to meet applicable building code requirements, and to accommodate
the construction of a drainage swale.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve an
encroachment agreement to permit a five-foot encroachment into the drainage and utility
easement for the purpose of constructing a retaining wall on property located at 12646
Ethan Avenue.
