HomeMy WebLinkAbout2000.11.06 RESO 2000-0046V RESOLUTION 2000 - 46 REVISING THE CONDITIONAL USE PERMIT FOR DANIEL AND ELAINE RAMBERG FOR HORSE TRAINING AND BOARDING FACILITIES FOR PROPERTY LOCATED AT 5676 -170TH STREET NORTH WHEREAS, Daniel and Elaine Ramberg have requested a revision to the conditional use permit for horse training and boarding facilities on property legally described as follows: Insert Legal Description WHEREAS, the revision does not result in a substantive change to the approved conditional use permit; but rather, is intended to clarify the purpose and intent of condition 5. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, MINNESOTA, that it should and hereby does approve the revision to the conditional use permit for Daniel and Elaine Ramberg on property located at 5676-170x` Street North. The revised conditional use permit shall be subject to the following conditions: 1. A conditional use permit is approved for horse training and boarding facilities, in accordance with the plans and application received by the City on August 28, 2000. 2. The conditional use permit for the horse training and boarding facilities is in addition to the existing conditional use permit for the rodeo and tack shop. Any ancillary events or operations shall be directly related to the primary uses identified in the conditional use permits. 3. The applicant shall obtain all necessary state and local permits, and said permits are not abrogated by the issuance of the conditional use permit. 4. The number of horses boarded on the property shall not exceed 125 horses. 5. The conditional use permit is for the 182 acres included in the application dated August 28, 2000. If the amount of land area devoted to the conditional use permit is reduced, the City shall review the conditional use permit for consistency with ordinance standards. Resolution 200046 Page 2 6. Any public address system used in connection with the horse training and boarding facilities shall be located and oriented in a manner to minimize noise pollution for neighboring properties/occupants, and shall be operated in conformance with Minnesota Noise Pollution Control Rules prescribed in a Guide to Noise Control in Minnesota (Minnesota Pollution Control Agency and as updated from time to time), and in compliance with Minnesota Statutes 116.07, subd. 2, and 4. 7. Exterior lighting shall be permitted in accordance with Section 6.37. In all instances, however, all lighting shall be directed away from adjacent properties and from public rights-of-way. All lighting shall be turned off by 11:00 PM, except for security lighting. 8. The conditional use permit is approved based on the finding that the hoarse training and boarding facilities comply with the standards provided in Section 8.8 c. of the Comprehensive Land Use regulations. More specifically, the City Council finds the following: a. The proposed use is permissible by law. The horse training and boarding facilities are allowed in the Agricultural -zoning district subject to the approval of a conditional use permit. b. The proposed use is keeping with the spirit and intent of the ordinance. The proposed horse training and boarding facilities are consistent with the Agricultural zoning of the property. c. The proposed use is compatible with the City's Comprehensive Plan, and the character of the surrounding area. Horse training and boarding is consistent with the Urban Reserve land use classification of the City's Comprehensive Plan, which is to preserve large tracts of land for possible future urban development. d. The proposed use has adequate drainage, water supply, electrical, gas, and sewage treatment facilities. The existing horse boarding and training facilities are served with a well and septic system, and has adequate drainage. e. The proposed use has adequate road access. The subject property receives direct access off 170t` Street North. The horse training and boarding facilities do not generate a significant amount of traffic. f. Technical Evaluation of Floodplain. The proposed horse training and boarding facilities would not be located within the floodplain. g. The proposed use should not increase the potential for flood damage. The proposed use would not obstruct the floodplain or increase the potential for flooding. The horse training and boarding facilities are over 1,000 feet from Hardwood Creek and are located outside of the floodplain. Resolution 2000-46 Page 3 h. The proposed use will not damage or reduce the benefits the public receives from public waters. The proposed operation would not damage or reduce the benefits from any public waters, including Hardwood Creek which runs through the subject property. The horse training and boarding facilities are over 1,000 feet from Hardwood Creek and are located outside of the floodplain. i. The use of watercraft on public waters. The proposed use would not involve the use of watercraft. j. All structures shall be screened from view of public waters. The horse training and boarding facilities are not visible from Hardwood Creek. k. Wetland impacts. The proposed use would not impact any wetlands. 1. All state and local permits shall be acquired for the conditional use. The applicant will be responsible for obtaining all state and local permits. in. Adequate screening and bufferingfrom non -compatible uses and public rights-of- way. The agricultural buildings used for the horse training and boarding operations are screened from adjacent residential properties by existing vegetation.
