HomeMy WebLinkAbout2000.12.04 RESO 2000-0049RESOLUTION 200049 A RESOLUTION VACATING PREVIOUS ACTIONS AND RESOLUTIONS RELATED TO THE 129TH STREET PUBLIC IMPROVEMENT PROJECT AND REFUNDING ANY MONEYS RELATED TO THE PROJECT THAT WERE PAID BY PROPERTY OWNERS WITH INTEREST AS DETERMINED BY THE CITY FINANCE DIRECTOR WHEREAS, the City of Hugo, received a petition of affected property owners to provide local sewer and water service; and, WHEREAS, the City of Hugo, in response to the petition, ordered a feasibility report for public improvements; and, WHEREAS, the City of Hugo, approved Resolution 1999-2 adopting the assessment roll for the 129` Street Public Improvement Project; and, WHEREAS, the City of Hy, approved Resolution 1999-6 ordering improvement and plans and specifications for the 129 Street Public Improvement Project; and, WHEREAS, the City of Hugo, approved Resolution 1999-18 modifying the assessment collection structure for the 129' Street Public Improvement Project; and, WHEREAS, over 20 months has passed since the adoption of Resolution 1999-6 ordering improvement and plans and specifications for the 129' Street Public Improvement Project; and,- WHEREAS, nd, WHEREAS, plans and specifications have not been completed for the project; and, WHEREAS, contractors bids have not been solicited for the project; and, WHEREAS, construction has not proceeded for the project; and, WHEREAS, some of the assessments have been paid by property owners. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA, that the following occur: 1. Resolution 1999-2 adopting the assessment roll for the 129' Street Public Improvement Project be vacated. 2. Resolution 1999-6 ordering the improvement and plans and specifications for the 129` Street Public Improvement Project be vacated. 3. Resolution 1999-18 modifying the assessment collection structure for the 129` Street Public Improvement Project be vacated. 4. The City's Finance Director shall refund any assessments paid to the City of Hugo by property owners, or on behalf of property owners, listed on the Assessment Roll attached to Resolution 1999-2 plus applicable interest as determined by the Finance Director. j Motion to approve this resolution was made by: Becky Petryk Seconded by: Debra Barnes Voting AYE: Barnes, Haas, Leroux, Petryk, Stoltzman Voting NAY: NONE Whereupon said resolution was declared passed and adopted this 4t' day of December, 2000.
