RESOLUTION 1999-9 CITY OF HUGO WASHINGTON COUNTY, MINNESOTA A RESOLUTION VACATING THE SPECIAL ASSESSMENTS WHICH WERE APPROVED FOR THE OAKSHORE PARK PUBLIC IMPROVEMENT PROJECT. WHEREAS, on November 16, 1998, the Hugo City Council approved the final. assessment roll for the Oakshore Park Public Improvement Project; and, WHEREAS, on September 8, 1998, the public improvement hearing was held; and, WHEREAS, Minnesota Statutes Section 429.031 provides that a Resolution ordering an improvement must be made within six (6) months of the date of the public improvement hearing; and, WHEREAS, more than six (6) months have expired since the date of the public improvement hearing and, accordingly, the project can no longer be approved. Accordingly, the approved assessment roll should now be vacated; and, WHEREAS, certain property owners have already paid their assessments in full; and, WHEREAS, the money paid to the City has been held by the City in an interest bearing account; and, WHEREAS, said money should be refunded, plus accrued interest, to those property owners who have already paid their assessments. NOW, THEREFORE, on motion duly made, seconded and approved, be it resolved by the City of Hugo, Washington County, Minnesota, as follows: 1. The approved assessment roll for the Oakshore Park Public Improvement Project, approved by the City Council on November 15, 1998, is hereby vacated. 2. City Staff shall take such steps as are necessary to formally vacate and/or decertify said approved assessment roll. 3. Any money received by the City pursuant to said approved assessment roll shall be returned to those individuals who paid the money in, plus accrued interest.
