RESOLUTION 1999-9 <br />CITY OF HUGO <br />WASHINGTON COUNTY, MINNESOTA <br />A RESOLUTION VACATING THE SPECIAL ASSESSMENTS WHICH WERE APPROVED <br />FOR THE OAKSHORE PARK PUBLIC IMPROVEMENT PROJECT. <br />WHEREAS, on November 16, 1998, the Hugo City Council <br />approved the final. assessment roll for the Oakshore Park Public <br />Improvement Project; and, <br />WHEREAS, on September 8, 1998, the public improvement <br />hearing was held; and, <br />WHEREAS, Minnesota Statutes Section 429.031 provides that <br />a Resolution ordering an improvement must be made within six (6) <br />months of the date of the public improvement hearing; and, <br />WHEREAS, more than six (6) months have expired since the <br />date of the public improvement hearing and, accordingly, the <br />project can no longer be approved. Accordingly, the approved <br />assessment roll should now be vacated; and, <br />WHEREAS, certain property owners have already paid their <br />assessments in full; and, <br />WHEREAS, the money paid to the City has been held by the <br />City in an interest bearing account; and, <br />WHEREAS, said money should be refunded, plus accrued <br />interest, to those property owners who have already paid their <br />assessments. <br />NOW, THEREFORE, on motion duly made, seconded and <br />approved, be it resolved by the City of Hugo, Washington County, <br />Minnesota, as follows: <br />1. The approved assessment roll for the Oakshore Park <br />Public Improvement Project, approved by the City Council on <br />November 15, 1998, is hereby vacated. <br />2. City Staff shall take such steps as are necessary to <br />formally vacate and/or decertify said approved assessment roll. <br />3. Any money received by the City pursuant to said <br />approved assessment roll shall be returned to those individuals who <br />paid the money in, plus accrued interest. <br />Adopted by the City Council this 3rd day of May, 1999. <br />Walter L.
