RESOLUTION 1998-35 RESOLUTION DECLARING COST TO BE ASSESSED, APPROVING THE PROPOSED ASSESSMENT ROLL, AND ORDERING A HEARING ON THE PROPOSED ASSESSMENT FOR THE OAKSHORE PARK PUBLIC IMPROVEMENT PROJECT WHEREAS, on November 6, 1995, the Council received a petition from property owners in the Oakshore Park subdivision for the extension of municipal water and sanitary sewer mains,- reconstruction ains;reconstruction of streets, curb and gutter, and stomp sewer, pursuant to Minnesota Statutes, Section 429.011 to 429.111 to the real property abutting the following streets: Ethan Avenue from 126th Street to the south line of N 1/2 of Section 31, T31, R21 W; Everton Avenue from 126th Street to the south line of the Oakshore Park Subdivision; Europa Avenue from 126th Street to the south line of the Oakshore Park Subdivision; 125th Street from Exhall Avenue to the west line of Ethan Avenue; 126th Street Court from 126th Street to the end of the cube -sac; and Exhall-Avenue from the north line of -the Oakshore-P-ark.to 126th -Street; -and ordered the City Engineer to prepare a feasibility report for the making of such improvements; and WHEREAS, the Council conducted a public improvement healing on the proposed project on January 8, 1996, which was continued on February•20,1996 and April 1,1996; and WHEREAS, the Council received a written report from the firm of Dahlen S Dwyer, Inc., dated March 1, 1996, on the special benefits property owners would obtain from the proposed improvements; and WHEREAS, the Council, on April 1, 1996, tabled action on the proposed subdivision until such time as the public improvements foreseen as part of the Woods of Bald Eagle Subdivision were finalized through a signed Development Agreement and posting of necessary escrow, as the cost estimates for the Oakshore Park improvements were based on the Woods of Bald Eagle development occurring first; and WHEREAS, following the construction of improvements as part of the Woods of Bald Eagle subdivision, the Council ordered the improvement process to begin anew and directed the City Engineer to update project cost estimates for the Oakshore Park Improvements on August 3, 1998; and WHEREAS, the Council conducted a public hearing on the proposed project on September 8, 1998, which was continued on October 5,1998; and WHEREAS, the Council has received a project cost estimate from the City Engineer, dated October 18, 1998, and a proposed assessment roll prepared by the City Administrator dated August 31; 1998; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF HUGO, MINNESOTA: 1. The cost of proposed improvements to be paid by the City is estimated to be $523,180, and the portion of the cost to be assessed against benefited property owners is declared to be $738,820. 2. Assessments shall be payable in -equal annual installments extending over a period of fifteen (15) years, the first of the installments to be payable on or before the first Monday in January, 2000, and shall bear interest at the rate of eight percent (8) per annum from the date of adoption of the assessment resolution. 3. A hearing shall be held on the 16th day of November in the City Hall at 7.05 p.m. to pass upon the proposed assessment, and at such time and place, all persons owning property affected FADATAIWORDWIISCIOSPAS.DOC .. by such improvements will be given an opportunity to be heard with reference to such assessment. 4. The City Clerk is hereby directed to publish a notice of the hearing on the proposed assessment in the official newspaper of the City at least two weeks prior to the date of the hearing, and shall state the total cost of the improvement in such notice. The Clerk shall also cause mailed notice to be. given to the owner of each parcel described in the assessment roll not less than two weeks prior to the hearings. S. The owner of any assessed property may, at any time priorto certification of the assessment to the county auditor, pay the whole assessment on such property, with interest accrued to the date of payment, except that no interest shall be charged ff the entire assessment is paid within 30 days from the adoption of the assessment.
