A RESOLUTION APPROVING THE DISSOLUTION OF THE
BROWN'S CREEK WATERSHED MANAGEMENT
ORGANIZATION
WHEREAS, the City of Hugo is a member community of a joint powers
organization known as the Brown's Creek Watershed Management Organization.
WHEREAS, the City of Hugo is aware that efforts by the Brown's Creek
WMO to update its Joint Powers Agreement have failed.
WHEREAS, the City of Hugo is aware that the Minnesota Board of Soil
and Water Resources has declared that The Brown's Creek WMO has failed to
implement its plan through failure to update its Joint Powers Agreement to provide
the powers to do so.
WHEREAS, the Brown's Creek WMO Board of Commissioners voted on
August 21, 1996, to recommend that the member communities unanimously agree
to dissolve the current Brown's Creek WMO Joint Powers Agreement pursuant to
Section 8.2 of the Agreement.
NOW, THEREFORE, based on the foregoing, the following resolution was duly
made, seconded, and approved:
1. The City Council of the City of Hugo supports the recommendation of the
Brown's Creek WMO Commissioners that the Joint Powers Agreement be
dissolved.
2. The City of Hugo agrees with the findings of the Board of Water and Soil
Resources that the Brown's Creek WMO has failed to implement its plan.
3. The City of Hugo hereby approves the dissolution of the Joint Powers
Agreement forming the Brown's Creek Watershed Management Organization -
Voting AYE: Agness, Barnes, Goiffon, Moon
Voting NAY: NONE
Where upon said resolution was declared passed and adopted this 21st day of
October, 1996.
