A RESOLUTION REQUESTING THAT WASHINGTON COUNTY
ASSUME RESPONSIBILITY FOR THE CONSTRUCTION AND
MAINTENANCE OF A STORMWATER CONTROL OUTLET TO
CONTROL THE FLOODING OF THE SCHOOL SECTION/GOGGINS
LAKE DRAINAGE BASIN.
WHEREAS, since the late 1980's, School Section Lake, Plaisted Lake, and
Goggins Lake have experienced increased water elevations; and
WHEREAS, in the summer of 1995, the surface water level in the basin exceeded
the lakes' ordinary high water level by approximately six feet, inundating over 200
acres of land, one County road, one City street, while affecting numerous homes,
and
WHEREAS, the flood waters have not substantially receded since 1995, causing
concern that future spring stormwater runoff will compound already high water
levels; and
WHEREAS, the Town of May and City of Hugo entered into a Joint Powers
Agreement dated January 22, 1996, establishing a storm sewer improvement
district for the watershed of School Section Lake, Plaisted Lake, and Goggins
Lake; and
WHEREAS, a report prepared by the civil engineering firm of Montgomery
Watson, dated August 1996, determined the feasibility of establishing an outlet
from the basin to Brown's Creek for the purpose of reducing the flood waters; and
WHEREAS, a report prepared by Montgomery Watson, dated December 1996,
demonstrated that the water elevation of the basin could be controlled through
such an outlet without adversely impacting the property owners, or environment,
downstream from the outlet; and
WHEREAS, construction of the outlet to Brown's Creek will require obtaining
drainage easements outside of the municipal boundaries of the Town of May and
City of Hugo; and
WHEREAS, with the dissolution of the Brown's Creek Water Management
Organization the responsibility for surface water management within the watershed
rests with Washington County; and

WHEREAS, available funding sources for the project have been researched and
considered, including grants-in-aid from the U.S. Army Corps of Engineers, U.S.
Department of Agriculture, the Federal Emergency Management Agency, and
Minnesota Department of Natural Resources;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Hugo, Washington County, Minnesota, that it is necessary to construct an outlet
from Goggins Lake to alleviate and control flood waters in the basin and to protect
the public's health and safety; and
FURTHERMORE, the Washington County Board of Commissioners, serving as
the water management organization for the Brown's Creek Watershed, is
requested to construct and maintain the proposed outlet from the School Section
Lake, Plaisted Lake, and Goggin's Lake basin as soon as practical; and
FURTHERMORE, that the most timely, practicable, and equitable method for
funding such an improvement is through assessments levied on the contributing
area under Minnesota Statutes Chapter 444; and
FURTSERMORE, Washington County and the City of Hugo should make
contributions to the project's funding in proportion to their avoided costs of not
having to reconstruct County Road 57 and 140th Street, if the outlet is emplaced.
Upon roll call, the following members voting AYE: Goiffon, Leroux, Miron
Voting NAY: NONE
Whereupon said resolution was declared passed and adopted this 19th day of
December, 1996.
