RESOLUTION NO. 1995- '-
A
A RESOLUTION VACATING A PUBLIC UTILITY EASEMENT IN EXCHANGE FOR
OBTAINING A NEW PUBLIC UTILITY EASEMENT IN THE SAME PRACTICAL
LOCATION.
WHEREAS, the above -entitled matter came on for a public
hearing before the City Council of the City of Hugo, Washington
County, Minnesota, on the 6th day of February 1995;
and,
WHEREAS, following a public hearing regarding this issue,
the City Council hereby determines that it is in the best interests
of the City of Hugo to vacate a portion of the existing public
utility easement located across property which is located at 5725
148th Street North, City of Hugo, Washington County, Minnesota, in
exchange for another public utility easement which is located in a
more practical place.
NOW, THEREFORE, based upon a motion duly second and
approved, the City Council hereby directs as follows:
1. The existing public utility easement legally
described as follows:
Document Number 324256:
A permanent utility easement 20 feet in width and having
northerly and southerly boundaries parallel to the North
right-of-way line of 147th Street N. and lying within the
Northeast Quarter (NEU) of the Northwest Quarter (NW's),
Section 20, Township 31 North, Range 21 West, Washington
County, Minnesota, the centerline of which is described
as follows:
Beginning at a point, said point being 135 feet
(more or less) north of the north right-of-way line
of 147th Street N. and 173 feet east of the
easterly right-of-way line of Forest Boulevard
(U.S. Highway 61) on a line parallel to said North
right-of-way line of 147th Street N., said
centerline extending parallel to said easterly
right-of-way line of Forest Blvd., a distance of
138 feet (more or less) and there terminating,
subject to easements of record;
(Comprising 0.06 acres more or less)
is hereby vacated.
2. The City hereby authorizes and directs the Mayor and
City Council to execute a Quit Claim Deed as approved by City Staff
conveying to Granger's, Inc. the land previously existing within
the public utility easement.
3. That said Quit Claim Deed shall not be delivered to
Granger's, Inc. until the City receives from Granger's, Inc. a
fully executed Utility Easement Grant as approved by the City Staff
conveying to the City the new utility easement, it being the intent
of the City Council that the existing public utility easement shall
not be vacated until the City has obtained the new Utility Easement
Grant from Granger's, Inc..
Whereupon the following voted in favor of the motion:
Debra Barnes, Andrew Goiffon, Marvin LaValle, Fran Miron
Wherein the following voted against the motion: NONE
Adopted by the City Council this day of 1995.
