RESOLUTION ENDORSING FORMATION OF A BROWN'S
CREEK WATERSHED DISTRICT
WHEREAS, the portion of the City of Hugo lying within the boundaries of
the Brown's Creek watershed has been subject to flooding in 1986, and
again in 1995, and
WHEREAS, such flooding has posed a threat to the public health, safety,
and welfare by inundating septic systems, threatening damage to human
habitation, and blocking public roads, and
WHEREAS, it is necessary to establish a management plan for, and construct
improvements to. the Brown's Creek watershed in order to alleviate current
flooding, protect against future flooding, protect public and private
investment, and provide stewardship for the natural environment, and
WHEREAS, the preparation of such a plan, construction of necessary
improvements, and management of the watershed is best performed by a
public body with the necessary authority and jurisdiction to coordinate,
conduct and implement the plans, improvements and management activities,
and,
WHEREAS, Minnesota Statutes, Section 103D.101, grants the authority to
establish watershed districts to the Board of Water and Soil Resources
after the filing of an establishment petition, and
WHEREAS, Minnesota Statutes, Section 103D.205, Subdivision 3 allows a
County having 50 percent or more of the area within the proposed watershed
district to file such a petition with the Board of Water and Soil
Resources, and
WHEREAS, the Brown's Creek watershed lies entirely within the boundaries
of Washington County, Minnesota,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO,
WASHINGTON COUNTY, MINNESOTA, that it requests the Washington County Board
of Commissioners file a petition with the Board of Water and Soil
Resources to establish a watershed district within the boundaries of the
Brown's Creek Watershed Management Organization for the purpose of
conserving natural resources, alleviating damage from flood waters, and
protecting the public's health, safety, and welfare.
Upon roll call, the following voting AYE: Barnes, Goiffon, LaValle,
Lerouxp Miron
Voting NAY: NONE
Whereupon said resolution was declared passed and adopted this 18th day of
September. 1995.
