HomeMy WebLinkAbout1995.10.16 RESO 1995-0016RECEIVED yr 4 CITY OF HUGO WASHINGTON COUNTY, MINNESOTA RESOLUTION NO. 1995- 16 A RESOLUTION ESTABLISHING A MINIMUM MAINTENANCE STANDARD FOR A DEDICATED CITY STREET. WHEREAS, the City of Hugo has the authority pursuant to Minnesota Statutes 5412.221, Subd. 6, to lay out, open, change, widen, extend, grade, pave, repair, control, and maintain City streets; and, WHEREAS, the City Council is also empowered pursuant to Minnesota Statutes 5412.221, Subd. 32, to provide for the government and good order of the City; and, WHEREAS, Minnesota Statutes S 160.095 provides that a Minimum Maintenance Road may be provided for; and, WHEREAS, in fulfilling its duties, the City Council must make decisions between competing interests of public purposes. Those decisions must wisely allocate the public funds available to the City Council based upon the Council's determination of needs and priorities; and, WHEREAS, the Council is fully aware that some City streets are utilized less than other City streets. Those streets with lesser usage do not need to be constructed or maintained to as high a level of service as the main thoroughfares; and, WHEREAS, Everton Avenue North (located south of 165th Street) is a public road extending for approximately one-fourth (1/4) of a mile. While this road is a public street, the Council is aware that it is used very sparingly by the public. It is used, at most, only occasionally or intermittently by passenger or commercial travel. In fact, it may well be the least utilized public street in the City of Hugo; and, WHEREAS, while it is the City's intent to keep the road passable, it is not the City's intent to expend unnecessary City funds on a City street which is rarely used; and, WHEREAS, the City believes that other options are available to keep the street open, and yet to insure the safety of the public. NOW, THEREFORE, based upon the foregoing, the following Resolution was duly made, seconded and approved: 1. That Everton Avenue North (located South of 165th Street) is hereby declared a "Minimum Maintenance Road." 2. That the City Staff is directed to insure that Everton Avenue North (south of 165th Street) remains passable and useable to the vehicles which traditionally travel over it. 3. The City Staff is hereby directed to post signs at the entrance to Everton Avenue North (south of 165th Street) advising motorists that it is a ".Minimum Maintenance Road" said signs shall also advise motorists that they travel it at their own risk. 4. The City staff is hereby directed to notify the road authorities of all adjoining jurisdictions of the designation of this road as a Minimum Maintenance Road. WHEREUPON, a vote being taken upon the motion, the following members voted in favor: Debra Barnes, Andrew Goif fon, Marvin LaValle, Fran Miron The following voted against: NONE WHEREUPON, said motion was declared duly passed this 16th day of October 1995. • Fran Miron, Mayor Attest: Mary Ann Creager, City Clerk 0�
