HomeMy WebLinkAbout1994.05.02 RESO 1994-0009CITY OF HUGO WASHINGTON COUNTY, MINNESOTA RESOLUTION NO. 1994_9 A RESOLUTION FORMALISING THE CITY'S WITHDRAWAL FROM THE MUNICIPAL LITIGATION COMMITTEE AND JOINT POWERS AGREEMENT REGARDING THE FOREST LAKE DISTRICT MEMORIAL HOSPITAL WHEREAS, the City of Hugo is one of the municipalities that participated in a litigation committee regarding Forest Lake Memorial Hospital District; and, WHEREAS, the committee helped direct a lawsuit brought pursuant to the authority of a joint powers agreement entered into by various local communities, namely: the City of Forest Lake, the City of Hugo, the Town of Columbus, and the Town of Forest Lake; and, WHEREAS, said lawsuit concluded in favor of the municipalities nearly one year ago. Nonetheless, there have been additional bills for legal fees incurred by the litigation committee since that time; and, WHEREAS, the City of Hugo has taken no part in ordering or directing any further work to be done relative to the lawsuit since the case was resolved; and WHEREAS, the City of Hugo views this matter as being closed and has no desire to be billed for any more services with respect to this matter; and, WHEREAS, the City Council finds that it is appropriate to notify all other member municipalities that it is hereby formally withdrawing from the litigation committee and from the joint powers agreement; and, WHEREAS, the City of Hugo intends by this Resolution to notify the other municipalities that it will no longer financially contribute to any of the expenses incurred in relation to the issue. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA: 1. The City Council of the City of Hugo hereby withdraws from the litigation committee and from the joint powers agreement (each of which were formed with regard to the lawsuit against the Forest Lake District Memorial Hospital). 2. The City of Hugo will no longer participate in any activities of the committee. Similarly, the City of Hugo will no longer financially contribute to any of the expenses incurred in relation to the issue. 3. The City Administrator is hereby directed to mail a photocopy of this Resolution to the City/Town Clerk or City/Town Administrator for each of the other members of the litigation committee to inform them of the City of Hugo's withdrawal from the committee and from the joint powers agreement. WHEREAS, the City of Hugo has adopted the Uniform Street Naming and Property Numbering System for Washington County by ordinance, and WHEREAS, the City has approved the Country Ponds Subdivision, recorded by the Washington County Recorder as document #803257 on the 6th day of June. 1994, at 1:29 PM, and WHEREAS, the Country Ponds Subdivision, as approved and recorded, had a certain street named 11136th Street", which is not in conformance with the City's Uniform Street Naming System. and WHEREAS, it is in the best interest of public safety and convenience to maintain a consistent street -naming system to insure prompt response of emergency vehicless when such is necessary, and to aid the public in commercial and social activities; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGOV WASHINGTON COUNTY, MINNESOTA, That the name of that street recorded as "136th Street", located in the Country Ponds Subdivision in the SW 1/4 of the NW 1/4 and the NW 1/4 of the SW 1/4 of Section 29, T31Np R21W, Washington County, MN., be changed to "134th Street" in accordance with the City's Uniform Street Naming System.
