RESOLUTION NO. 1994-20
A RESOLUTION OUTLINING THE CITY 18 PROPOSAL TO THE UNITED STATES
POSTAL SERVICE FOR THE CONSTRUCTION OF A NEW POST OFFICE IN THE
CITY OF HUGO.
WHEREAS, the City of Hugo is the owner of two parcels of land
located in the City of Hugo, Washington County, Minnesota. Either
of the parcels would be suitable for the construction of a new post
office; and,
WHEREAS, the northern parcel is legally described as Lots 1
through 6 (inclusive), Block 1, Hugo Addition. The land is
located in Section 20, Township 31 North, Range 21 West, Washington
County, Minnesota; and,
WHEREAS, the southern parcel is legally described as Lots 7
through 12 (inclusive), Block 3, Hugo Addition. The land is
located in Section 20, Township 31 North, Range 21 West, Washington
County, Minnesota; and,
WHEREAS, the both parcels are located in a Single Family Urban
(SFU) zoning district. Both parcels are also located in the direct
vicinity of a Commercial -Business (CB) zoning district. That a
post office could be constructed and operated in a CB zoning
district; and,
WHEREAS, the City of Hugo would entertain and approve, if
appropriate, a rezoning of the above described property to a CB
designation if the proposal is accepted; and,
WHEREAS, either of the parcels in question is of adequate size
for use as a post office. Specifically, they are approximately 1.2
acres in size. Additionally, exclusive of setbacks, easements, and
other similar limitations, the parcels are of ideal size for use
as a post office; and,
WHEREAS, the northern parcel has a convenient access to U.S.
Highway 61 and the southern access has a convenient access to
County Road 8. Consequently, either site would allow for an
efficient flow of traffic; and,
WHEREAS, Minnesota Statute section 412.211 et seq. authorizes
the City to control, hold, manage, convey, and/or lease real
property. The City also has the right to construct such structures
as are necessary for city purposes; and
WHEREAS, the City Council intends to hereby set forth the
general terms of a formal proposal for the construction and lease
of a new post office that it intends to forward to the United
States Postal Service; and,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF HUGO, WASHINGTON COUNTY, MINNESOTA:
1. The City Council of the City of Hugo hereby intends to
draft a formal proposal to the United States Postal Service for the
construction of a new post office at either of the above locations.
The Postal Service could choose either site they desire.
2. The City will construct a building upon the property
chosen by the Postal Service. The building will be constructed to
meet the requirements of the Postal Service.
3. Said building would then be leased to the Postal Service
subject to the terms herein (and such other and further terms as
are finally negotiated between the City and the Postal Service).
4. The lease of the land and building to the Postal Service
shall run for a period of twenty (20) years.
5. The real estate will be leased to the Postal Service at
the rate of $ 8,500.00 per year.
6. The lease payments for the building will equal the
City's mortgage/bond payments for the construction of the facility
(as amortized out for twenty years).
7. The Postal Service shall be responsible for the payment
of all costs associated with the operation of the post office to
include, but not be limited to, taxes, utilities, garbage pick-
up, water, sewer, maintenance, etc.
8. The Postal Service shall at its sole cost and expense
maintain in good condition the building and property. At the end
of the twenty year term the building and property shall be turned
back over to the City in good condition.
9. The lease shall also include such other terms as are
necessary, feasible, and/or in the best interests of the City of
Hugo and the Postal Service.
