HomeMy WebLinkAbout1992.01.21 RESO 1992-0002RESOLUTION 1992-2 RESOLUTION FOR NOTIFICATION OF AFFECTED LANDOWNERS AND SETTING PUBLIC HEARING FOR VACATION OF A ROAD RIGHT-OF-WAY WITHIN THE CITY OF HUGO WHEREAS, the City of Hugo, Washington County, Minnesota, hereinafter the "City", was made a party to litigation initiated by Joseph B. Stanek and Marilyn D. Stanek, husband and wife, identified as Court File No. C190-2.482 in Washington County Court, and WHEREAS, the litigation in part involved a dispute of to rights in a public right-of-way established on or about June 10, iegg, being four (4) rods wide, with the centerline described as follows: Beginning at the corner post at the NW corner of the SW 1/4 of Section 12, T31N, R21W, and running North on the Section line between Sections 11 and 12,, and I and 2 as near as practicable 1-1/2 miles more or less to the N.W. corner of Section One (1) and intersecting with the Town Line Road between the Towns of Oneka and Forest Lake and there terminating, WHEREAS, some of the named parties in said litigation have entered into a Settlement Agreement and Release, said parties being Joseph B. Stanek, Marilyn D. Stanek, Thomas Pogreba, Sharon Pogreba, Steven Erickson, Carolyn Erickson, Northern States Power, and the City of Hugo, and WHEREAS, said Settlement Agreement includes an undertaking of the City to initiate a street vacation proceeding for a portion of the disputed right-of-way; NOW THEREFORE BE IT RESOLVED, That the City Council of the City of Hugo hereby initiates a street vacation proceeding pursuant to the provisions of Minnesota Statutes Annotated, Section 412.851, to vacate a portion of the right-of-way described herein, said portion described as the disputed right-of-way between Sections I and 2 to the North of the Stanek property. BE IT FURTHER RESOLVED, That a Public Hearing be set for 7:00 PM, on the 18th day of February,, 1992, to be held in the Council Chambers, Hugo City Hall, 5524 Upper 146th Street, Hugo, MN, to hear public input regarding the proposed vacation. BE IT FURTHER RESOLVED, That Notice of the Public Hearing be published and posted not less than two weeks prior to the date for the Public Hearing. BE IT FURTHER RESOLVED, That a copy of this Resolution, and the proposed Resolution vacating the portion of the disputed right-of-way, be mailed to each property owner affected by the proposed vacation not less than ten* (10) days prior to the date of the Public Hearing. Upon roll call, members voting AYE: Barnes, Brunotte, Jesinski, Miron, Stoltzman Voting NAY: NONE Whereupon said Resolution was declared passed and adopted this 21st day of January, 1992. Walter L.
