HomeMy WebLinkAbout1992.08.17 RESO 1992-0020RESOLUTION 1992-20 RESOLUTION AUTHORIZING TRANSFER/SALE OF WILLIAM WITTMAN PROPERTY WHEREAS, on August 3, 1992, the Hugo City Council approved the subdivision of That part of the N1/2 of the NW1/4 of Section 22, T31N, R21W, Washington County, Minnesota, described as follows: Beginning at the North quarter corner of Sec. 22; thence south, along the north -south quarter line of Sec. 22, a distance of 988 feet; thence west, deflecting 90 degrees to the right, a distance of 1,320 feet, thence south deflecting 90 degrees to the left, a distance of 330 feet, more or less to the south line of the north 1/2 of the Northwest 1/4 of Sec. 22; thence westerly along said south line a distance of 1,320 feet more or less to the southwest corner of the North 1/2 of the Northwest 1/4 of Sec. 22; thence northerly, along the west line of Sec. 22, a distance of 1,320 feet more or less, to the northwest corner of Sec. 22; thence easterly along the north line of Sec. 22, a distance of 2,640 feet more or less to the point of beginning. Excepting therefrom the North 1/2 of the North 1/2 of the Northeast 1/4 of the Northwest 1/4 of Sec. 22, T31N, R21W; and Excepting therefrom the North 1/2 of the North 1/2 of tahe Northwest 1/4 of the Northwest 1/4 of Section 22, T31N, R21W; and Also excepting therefrom the North 1/2 of the South 1/2 of the Northeast 1/4 of the Northwest 1/4 of Section 22, T31N, R21W. Subject to Homestead currently owned by William F. Wittman and Patricia K. Wittman, into one 10 acre parcel and one 30 acre parcel; and WHEREAS, such approval was conditioned on the ten acre parcel being created by the subdivision, described as: The South 1/2 of the South 1/2 of the NW 1/4 of the NW 1/4 of Section 22, T31N, R21W, lying westerly of the following described line: Commencing at the North 1/4 corner of Section 22, thence South along the North-South quarter line of Section 22, a distance of 988.0 feet to the point of beginning, thence West deflecting 90 degrees to the right a distance of 1,320.0 feet; thence South, deflecting 90 degrees to the left, a distance of 330.50 feet to the South line of the North 1/2 of the NW 1/4 of Section 22. being combined with the adjacent property currently owned by Robert V. Fahnhorst and Jill K. Fahnhorst, and to be described as: That part of the North half of the Northwest 1/4 (N1/2 of NW 1/4) of Section 22, T31N, R21W, lying southerly of the following described line: Commencing at the north 1/4 corner of Section 22, thence south, along the north -south quarter line of Section 22, a distance of 988 feet to the point of beginning; thence west, deflecting 90 degrees to the right a distance of 1,320 feet; thence south, deflecting 90 degrees to the left to the north line of the south 1/2 of the S 1/2 of the NW 1/4 of the NW 1/4 of Section 22, T31N, R21W, thence westerly along said north line to the west line of the NW 1/4 of Section 22, T31N, R21W, and there terminating. ~ with such ten acre parcel to be indivisible from the Fahnhorst property without the approval of the Hugo City Council, in accordance with the Zoning Ordinance and subdivision regulations of the City of Hugo; and WHEREAS, the Wittmans' wish to convey the ten acre parcel to their daughter, Tami K. Wittman, prior to sale to the Fahnhorsts; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HU8O, WASHINGTON COUNTY, MINNESOTA, That the subdivision and transfer of the property described in this Resolution be allowed upon the condition that the transfer of the property to the Fahnhorsts be accomplished within 30 days of transfer of the property to Tami K. Wittman. Upon roll call, voting AYE: Brunotte, Leroux, Miron, Stoltzman Voting NAY: None Whereupon said Resolution was declared passed and adopted this 17th day of August, 1992. Walter L.
