HomeMy WebLinkAbout1991.08.12 RESO 1991-0012RESOLUTION 1991-12 RESOLUTION APPOINTING ACTING CITY PROSECUTOR TO HANDLE THE CIVIL PROSECUTION OF CAROL AND DAVID SCHUMANN FOR ALLEGED ORDINANCE VIOLATIONS WHEREAS, the Hugo City Council directed the civil prosecution of David and Carol Schumann, for alleged ordinance violations, on September 4, 1990, and WHEREAS, pursuant to Resolution 1998-44, the City Council has directed its insurance company and/or City Attorney to defend the City, and file counter claims to recover expenses with regard to the lawsuits filed by Carol and David Schumann against the City of Hugo, and WHEREAS, the City Council at its August 5, 1991 regular meeting, acted to drop Mr. Richard Hocking as the City's prosecutor in its civil litigation against Carol and David Schumann because his being sued by the Schumanns may jeopardize the City's case, and WHEREAS, the City Council has directed the City Attorney, Charles Johnson, to provide the City Council with a list of names to replace Mr. Richard Hocking as acting City Prosecutor in this matter, NOW. THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF HUGO, WASHINGTON COUNTY, MINNESOTA: That said Council hereby appoints Mr. Jeff Carson as legal counsel from the law firm of Carson & Clelland to pursue the civil prosecution of Carol and David Schumann, and BE IT FURTHER RESOLVED, that said legal counsel shall pursue remedies and damages, including seeking recovery of attorney's fees, and all other expenses and damages to the extent allowable by law, pursuant to Resolution 1990-44 of the City Council. Upon roll call, the following members voting AYE: Brunotte, Jesinski, McAllister, Miron, Stoltzman Voting NAY: NONE Whereupon said resolution was declared passed and adopted this 12th day of August, 1991.
