RESOLUTION AUTHORIZING DEFENSE OF CITY OFFICIALS
AND FILING OF COUNTER CLAIM
WHEREAS, Carol A. and David J. Schumann have filed a Notice of Claims
pursuant to Minnesota Statutes, Chapter 466, charging the City with
defamationv malicious prosecutionv and violation of civil rightsv and
WHEREAS, The City Council acknowledges receipt of this claim received
on December 12, 1994, and
WHEREAS, It is the intent of the City to defend itself, and indemnify
its City officialsp and City employees, while acting in the performance of
their respective duties;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HUGOV
WASHINGTON COUNTY, MINNESOTA AS FOLLOWS:
1. The claims filed by Carol A. and David J. Schumann involving
defamation, malicious prosecution, and violation of civil rights, be
referred to the City's insurance company and/or City Attorney for
preparation of a proper defense on behalf of the City, its officials
and employees, and said defense shall include a counter suit to
recover legal and related expenses incurred.
2. The City should pursue remedies and damages, including seeking
recovery of attorney's fees, and all damages to the extent allowable
by law.
Upon roll call, the following members voting AYE: Jesinskiv McAllister,
Olson, Vails Atkinson
Voting NAY: NONE
Whereupon said resolution was declared
December, 1990.
