RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR TO FILE AN APPEAL OF THE
1988 LEVY LIMIT AS IT AFFECTS THE CITY OF HUGO
WHEREAS, recent state legislation restricts small cities under population
of 5,000 with a three percent (3%) tax levy limit, and
WHEREAS, the City ofHugo has not been subject to a levy limit in previous
years, and
WHEREAS, the city failed to collect budgeted homestead credit in 1984,
1985 and 1986 as a result of the tax levy error which affects the city's
tax levy base, and
WHEREAS, the city's tax levy base in turn affects the amount of local
government aid received by municipalities, and
WHEREAS, the legislature has frozen local government aids at the 1987
fiscal year level, and
WHEREAS, the City of Hugo is required to prepare a local water management
plan pursuant to Minnesota Statutes 473.878 in 1988 for submittal in
1989 at an estimated cost of $70,000.00, and
WHEREAS, the Minnesota law restricting the tax levy limit to three percent
(3%) annually would affect compliance with Minnesota Statutes 473.878
and other state mandates
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hugo,
Washington County, Minnesota that the City Administrator be and hereby
is authorized to file an appeal from the three percent (3%) levy limit
with the Commissioner of Revenue within the spirit of the appeals
process as provided by the State Legislature.
